For purposes of this chapter, the following
terms will be defined as follows:
A stormwater treatment system designed for the separation
and removal of insoluble oils or floating grease from stormwater runoff.
An embankment and associated space for impoundment of water
or, alternatively, the space for impoundment partially or entirely
created by excavation rather than by embankment, in either case designed
to temporarily retain stormwater runoff.
The purpose of this chapter is to require each
property owner upon whose property there has been installed either
an oil-water separator or a water quality basin to maintain the same
so that it will function properly and serve the purpose for which
it was intended and originally required to be installed. For this
purpose, the Township wishes to establish the procedure that shall
be followed, which procedure will include the right of the Township's
enforcement officer under this chapter, to enter upon property for
the purpose of making an inspection of those facilities, and to issue
appropriate orders requiring the same to be maintained in such a fashion
so that they will function appropriately, and to issue summonses if
violations occur, and for that purpose, all property owners shall
be required by way of this ordinance to properly maintain all oil-water
separators and water quality basins located on their property as required
by the enforcement officer hereinafter appointed.
All property owners upon whose property is located
an oil-water separator or water quality basin are hereby required
to maintain the same in a condition so that it will function to serve
the purpose for which it was intended and required to be installed.
All property owners upon whose property an oil-water separator or
water quality basin is located shall be required to affirmatively
respond upon written request issued by the Township's enforcement
officer under this chapter, to repair, reconstruct and/or maintain
either the oil-water separator or water quality basin located on their
property.
For purposes of this chapter, the Township Engineer
and Engineering Department are designated as the Township's enforcement
officer and agent respectively. The Township Engineer shall have the
authority to enter upon private property for the purpose of carrying
out the purpose of this chapter, i.e., to inspect all oil-water separators
and water quality basins to ascertain whether or not the separators
and/or basins are functioning as required to function in accordance
with standards established by the Township's enforcement officer,
a copy of which standards shall be forwarded to the owners of all
properties upon which are located oil-water separators and/or water
quality basins. The Township's enforcement officer, upon an inspection,
shall advise the property owner, in writing, of any maintenance requirements
or reconstruction, etc., that may be needed or necessary for the oil-water
separator and/or water quality basins located on the property for
the same to function properly, and said property owner shall be required
to take such steps within 10 days of receipt of the written notice
by the enforcement officer in order to make the same operate efficiently.
A.
In the event that a property owner who has been duly
notified, in writing, by the enforcement officer to take remedial
action in order that oil-water separators or water quality basins
on the property will function properly fails to do so within 10 calendar
days of receipt of written notice, the property owner shall be determined
to be in violation of the requirements of this chapter, and the enforcement
officer is authorized to issue a summons in the Municipal Court for
the Township of Hanover of said violation.
B.
Any property owner who is determined to be in violation
of the requirements of this chapter shall be subject to a fine of
$100 and/or 30 days in jail.
