Upon notification by the Southeast Morris County Municipal Utilities Authority (SMCMUA) that there is a shortage of water within the municipality or low pressure in its system or other emergency conditions affecting water supply or pressure and that no action has been taken by the Governor of the state with respect to such conditions, the local Emergency Management Director or the Mayor of this municipality is hereby authorized to declare and proclaim that an emergency exists and regulate, restrict or prohibit the nonessential use of water during such hours and for such period or periods of time as the SMCMUA shall prescribe and take such other action as may be necessary to protect the public health, safety and resources of the residents of this municipality.
It shall be unlawful for any person, firm or corporation to use any water supply of the SMCMUA within the municipality contrary to the provisions of any such declaration.
The declaration shall remain in effect until rescinded or until such time as any superseding action is taken by or on behalf of the Governor of the state or other governmental entity or officer having preemptory jurisdiction.
Nothing contained herein shall prohibit the use of water from private wells or other private sources or prohibit the use of water by this municipality or any other political subdivision of the state, or the agents or employees thereof, when the same is necessary for the health, safety and welfare of the public.

Any person, firm, or corporation who shall violate any of the provisions of this article or any declaration or proclamation issued hereunder shall be subject to a fine of not to exceed $1,000 or to imprisonment for not to exceed 90 days, or to both fine and imprisonment, in the discretion of the Court.
