Parking of any vehicle on any portion of a public
road, street or highway is prohibited whenever snow has fallen and
the accumulation is such that it covers the public road, street or
highway in the Township of Harding.
Said parking prohibition shall remain in effect
after the snow has ceased and until the streets, roads or highways
have been plowed sufficiently and to the extent that parking will
not interfere with the normal flow of traffic.
As used in this article, the following terms
shall have the meanings indicated:
SNOW
Any precipitation depositing any accumulation on the streets,
roads or highways, including snow, sleet, hail, ice or freezing rain.
As to §
250-14 of this article, regulatory and warning signs in accordance with N.J.S.A. 39:4-198 shall be erected and maintained at street, road or highway entrances for motor vehicles into this Township.
During extreme weather conditions, when a vehicle
is not able to proceed and must be parked on any street, road or highway
in the Township, the operator of such vehicle must, by the quickest
means of communication, notify a police officer of the Township on
duty and/or the Superintendent of Public Works of such vehicle.
Any unoccupied vehicle parked or standing in
violation of this article shall be deemed a nuisance and a menace
to the safe and proper regulation of traffic, and any police officer
may provide for the removal of such a vehicle. The owner of such vehicle
shall pay the reasonable costs of the removal and storage which may
result from such removal before regaining possession of such vehicle.
Upon the declaration of an emergency, there
shall be no parking upon any public road or street, or portion thereof,
in the Township of Harding where either a permanent or temporary emergency
no-parking sign is displayed. The ranking Harding Township police
officer on duty is authorized to declare such emergency and to direct
the posting of temporary emergency no-parking signs when, in his judgment,
weather conditions, accident, fire, public celebration or other similar
emergency situation requires the avoidance of hazards or other conditions
which interfere with the free flow of traffic. Notification that emergency
no-parking signs are being or will be posted shall be given to the
operator or owner of any vehicle which has been parked prior to the
posting of said signs. Placing written advice of such posting on or
in such a parked vehicle shall be deemed sufficient notification hereunder.

Unless another penalty is expressly provided
by New Jersey statute, every person convicted of a violation of a
provision of this article shall be liable to a penalty of not more
than $110 or imprisonment for a term not exceeding 15 days, or both.
