Whenever any words or phrases are used herein, the meanings
respectively ascribed to them in Subtitle 1 of Title 39 of the Revised
Statutes of New Jersey shall be deemed to apply to such words and
phrases.
A.
It shall be unlawful for any person or persons to park any motor
vehicle or other vehicle on any public street in the Township of Independence
when, during such period, there shall be a covering of streets of
at least three inches of snow determined by an authorized member of
the Independence Police Department. This prohibition shall be continuous
until such time that the snowplowing operations, for the storm event,
shall be completed and the available travelway will readily accommodate
normal traffic and emergency vehicles.
Any vehicle parked in violation of § 149-2 may, at the discretion of the Township of Independence Police Department, be removed at the cost and risk of the owner. Any and all costs of removal shall be paid by the owner as a condition of recovery of possession of the vehicle.
Upon declaration of an emergency, by the Mayor or Chief of Police,
or his ranking subordinate, vehicular parking on public streets shall
be prohibited wherever so designated by "Emergency - No Parking" signs
(or other appropriate temporary signage). The Mayor, Chief of Police,
or his ranking subordinate may declare a condition of emergency whenever
weather, accidents, fire or other conditions are present which may
present public hazard and which will be ameliorated by prohibition
of parking during the emergency. Vehicles parked prior to the declaration
of emergency and posting shall not be deemed to be violative of this
article of this chapter unless, after notification, the owner thereof
shall fail to remove the vehicle from the controlled area.
In addition to the impounding, removal and storage provisions
set forth above, any person who shall violate this article shall be
subject to a fine not exceeding $50 or imprisonment for a term not
exceeding 15 days.
