There shall be the following administrative departments and offices in the government of the Town:

The head of each department of the Town government shall, subject to the Charter, the provisions of this Code and other ordinances of the Town:
A. 
Devote full time as required for the proper and efficient discharge of the duties of his office.
B. 
Have, exercise and discharge the functions, powers and duties of the department.
C. 
Prescribe the internal organization of the department and the duties of his subordinates and assistants.
D. 
Administer the work of the department through the divisions established by this chapter and such other units of administration as he may find necessary or desirable.
E. 
Appoint officers and employees employed within the department and assign functions, powers and duties to them, subject to the provisions of Title 11 (civil service statutes) of the Revised Statutes.
F. 
Delegate such of his powers as he may deem necessary for the efficient administration of the department to be exercised under his direction and supervision of division heads.
G. 
Report at least annually to the Mayor and Council on the work of the department during the preceding year.
H. 
Attend regular Council meetings and be available to answer questions from citizens and Council members upon advance notice to the Mayor by the Council of the necessity for the attendance of specific department heads.

Whenever a vacancy exists by resignation, removal, death or otherwise in any office of director of a department, head of a division or bureau or office, the Mayor may temporarily fill such vacancy in cases not otherwise specifically provided for in the Charter, this Code, other ordinances or general laws, by appointing an acting director or acting head from among the existing officers and employees of the Town, who shall perform all the duties and functions of such department, office or bureau head until such office shall be filled permanently. Any such appointment of an acting head or director shall terminate not later than 90 days after the date of the appointment, unless the Council shall by resolution authorize one or more extensions thereof. Any person serving beyond the ninety-day time period proscribed by law without the consent of the Municipal Council shall be removed from the municipal payroll in such capacity immediately upon notification of the Council to the administration.

No officer or employee, elected or appointed, in the Town government shall be interested directly or indirectly in any contract or job for work or materials, or the profits thereof, to be furnished or performed for the Town, and no such officer or employee shall be interested directly or indirectly in any contract or job for work or materials, or the profits thereof, to be furnished or performed for any person operating any interurban railway, street railway, gasworks, waterworks, electric light or power plant, heating plant, telegraph line, telephone exchange or other public utility within the territorial limits of the Town.
The Council shall cause to be made an annual audit of the Town's accounts and financial transactions as required by law. Such annual audit shall be made by a registered municipal accountant of the state selected by the Council.
The administrative functions, powers and duties of statutory and other agencies of the Town government not allocated and assigned by this chapter shall be subject to the supervision of the Mayor except as otherwise specifically required by law, and for this purpose such statutory and other agencies are allocated and assigned to the office of the Mayor.

The Chaplains for the Department of Public Safety and the Police and Fire Surgeon shall be appointed by the Mayor with the advice and consent of the Council for a term of office coinciding with that of the Mayor, and their compensation shall be fixed by ordinance. The four Chaplains and the Police and Fire Surgeon shall serve both the Division of Police and the Division of Fire within the Department of Public Safety.
Whenever, after organization, a division, bureau, unit or unit of functional duties shall, by ordinance, be transferred from one department to another department of the Town government, all the functions, powers and duties thereof shall be and are transferred as of the effective date of the ordinance.
