This chapter shall be known as the "Legalized Games of Chance Ordinance of the Township of Jefferson."
For the purpose of establishing rules and regulations for the supervision of the issuance of licenses within the municipality for the holding, operating and conducting of games of chance under such licenses, there is hereby adopted by the Township the Bingo Licensing Law and the Raffles Licensing Law as they are referred to and set forth in N.J.S.A. 5:8-24 through 5:8-76.

No person, organization or association shall hold, operate or conduct games of chance within the Township of Jefferson unless such person, organization or association shall have first obtained a license for such purpose from the Township Council or the Township Clerk, who is hereby authorized to issue such licenses. Said license, when issued, shall be in accordance with the rules and regulations duly adopted from time to time by the Legalized Games of Chance Control Commission of the State of New Jersey.
The application for each such license shall be made with the Clerk of the municipality in the form and with the fee as set forth in the rules and regulations of the Legalized Games of Chance Control Commission.

There is hereby established a fee in the maximum amount authorized by the State of New Jersey for every application for a license to conduct a game of chance. This fee shall be charged whether or not the organization making the application may be a qualified charity or not, pursuant to New Jersey regulations. The fee shall be in addition to any fees which must be payable to the Legalized Games of Chance Commission.

No application for the issuance of a license shall be refused by the governing body or the Township Clerk until after a hearing is held before the Township Council on due notice to the applicant, at which time the applicant shall be entitled to be heard upon the qualification of the applicant and the merits of the application.
The governing body may issue a license under this chapter authorizing the conduct of such legalized games of chance on the first day of the week, commonly known and designated as Sunday, and said license so issued shall be plainly marked accordingly.
The governing body of the Township of Jefferson shall have and exercise control and supervision over all games of chance held, operated or conducted under such license, to the end that the same are fairly held, operated and conducted in accordance with the provisions of such license, the rules and regulations promulgated by the Legalized Games of Chance Control Commission and the provisions of this chapter governing the holding, operation and conduct of the same, and the governing body and the Legalized Games of Chance Control Commission shall have the power and authority to suspend any license issued by the governing body and to revoke the same, after hearing, for any violation of any such provision, and shall by their respective officers and agents have the right of entry at all times into any premises where any such game of chance is being held, operated and conducted or where it is intended that any such game of chance shall be held, operated and conducted, or where any equipment being used or intended to be used in the conduct thereof is found, for the purpose of inspecting the same.

The Township Clerk is hereby authorized to issue any such license upon the payment by the applicant of the proper fee and after the approval of the application by the Township Council or the Township Clerk.
Any such license shall remain in force and be valid for such term as is set forth on the license and shall apply only to the person, organization or association to whom it is granted and shall not be transferable.
