As used in this article, the following terms shall have the meanings indicated:
ESSENTIAL VEHICLE
Those vehicles that are vital or necessary for the safe and orderly operation of the Township during a snow emergency, such as, but not limited to, police vehicles and public works vehicles.
SNOW
Any precipitation depositing any accumulation on the streets, roads or highways, including, but not limited to, snow, sleet, hail, or freezing rain.
SNOW EMERGENCY
Whenever snow has fallen and the accumulation is such that it covers a Township street, an emergency shall exist and no vehicle shall be parked on any Township street or portions thereof.
A. 
Parking of any vehicle on any portion of a Township road, street, or highway improved, designated, or ordinarily used for vehicular traffic is prohibited whenever snow has fallen and results in an accumulation sufficient to require plowing of Township roads, streets, or highways by the Little Egg Harbor Township Department of Public Works.
B. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
Any unoccupied vehicle parked in violation of this article shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal, before regaining possession of such vehicle.
Driving restrictions may be imposed as warranted by the severity of the storm to ensure the safety of the general public.
A. 
Nothing in this article shall be construed to permit parking at any time or place where it is forbidden by other provisions of the New Jersey statutes or the Township Code.
B. 
Nothing in this article shall be construed to conflict with the provisions of the New Jersey statutes pertaining to driving during emergencies.
A. 
Any person violating or failing to comply with any other provision of this article shall, upon conviction thereof, be punished by a fine not to exceed $1,250, by imprisonment not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service, as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
The violation of any provisions of this article shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
