There is hereby established a Department of Recreation and Parks, the head of which shall be the Director of Recreation and Parks.
The Department of Recreation and Parks shall:
A. 
Provide a year-round program of wholesome recreational activities for all Township residents;
B. 
Cooperate with other Township departments, service clubs and other organizations in furthering recreational interests in the Township;
C. 
Plan, develop and coordinate the use of recreational and park facilities;
D. 
Have and exercise the functions, powers and duties of a board of recreation commissioners as authorized by statute (N.J.S.A. 40:12-1 et seq.), subject to the requirements of the Charter and the Code of the Township of Livingston.

Enter into agreements and understandings with the Board of Education of the Township for joint and cooperative program planning, use of facilities, and subject to approval of the Manager, the maintaining of school grounds, planning and employment of personnel.
The Director of Recreation and Parks shall:
A. 
Administer the work of the Department with the assistance of such policy guides as may heretofore have been adopted by the Board of Recreation Commissioners;
B. 
Conduct studies of the present and future park and recreational needs of the Township, and develop immediate and long-range plans for recommendation to the Manager and the Township Council;
C. 
Operate such recreational areas, grounds, park facilities, swimming pools, buildings and structures as may be authorized by or pursuant to ordinance;
D. 
Maintain records as may be required to control departmental receipts, property and personnel, to evaluate programs and to provide information for budgeting, public reporting, planning and financing of recreational and park programs.

A. 
Appointment and removal. The Director of Youth Services shall be appointed by the Township Manager.
B. 
General powers and duties. The Director of Youth Services shall supervise the development of youth programs, develop and coordinate programs with drug counselors, supervise activities of the Youth Center and develop and coordinate programs in conjunction with the Recreation and Park staff.
C. 
Appointment at the pleasure of the Manager. The Director of Youth Services, appointed by the Township Manager, shall hold his appointment and employment at the pleasure of the Township Manager.

The Township Council is hereby authorized to adopt by resolution amendments, modifications, increases and/or decreases to the fee schedule for programs of the Department of Recreation and Parks of the Township from year to year or from time to time.

The Township Council is hereby authorized to adopt by resolution membership fees for admission to public swimming pools owned and operated by the Township from year to year.[1]

The Township Council is hereby authorized to adopt by resolution amendments, modifications, increases or decreases to the rental fee schedule for Township facilities of the Department of Recreation and Parks from year to year or from time to time. A copy of the fee schedule shall be maintained on file in the office of the Township Clerk.

A. 
A late payment fee of a minimum of $10 or 25% of the program fee rounded up to the next $5, whichever is greater, will be charged to individuals wishing to register for sports programs after the public registration date; and
B. 
The late payment fee will not guarantee registration acceptance into the Department's program as space and time limitations will continue to be a factor.
