A. 
No person shall tap a water main or make any water connection therewith prior to the issuance of a water connection permit by the Water Department of the Township of Livingston.

B. 
Prior to the issuance of a water connection permit; the applicant shall pay to the Township a water connection fee as hereinafter provided:

(1) 
For each connection to a Township water main, the fee shall be $1,359.40 per connection unit, as defined in Subsection B(2) and (3) hereof, in addition to the Township's inspection cost of $90.
(2) 
For purposes of this section, each individual residential dwelling unit shall be deemed to constitute a single connection unit. In the case of any other types of structures or uses, the Township Engineer shall determine the number of units, or fraction thereof, to be connected or added to an existing connection by dividing the proposed total average water demand for the structure by the annual average daily flow of 300 gallons per unit; $1,359.40 per unit. The minimum number of connection units shall be one.
(3) 
The Township shall provide credit for a property's past water usage by calculating the average water usage based on the property's prior annual water billings over the past three calendar years. This amount shall be deducted from the proposed regular demand for the structure to calculate the number of connection units.
C. 
For the reconstruction of an existing water connection where there is no change in the average daily flow, the connection fee shall be $90.

D. 
The fee shall, pursuant to N.J.S.A. 40A:31-11, be recalculated at the end of each budget year and may be reset by ordinance of the Township Council after public hearing, on a yearly basis. The water connection fee is based upon the usage of a single-family dwelling unit or equivalent discharge. The water connection fee shall be payable in full to the Township of Livingston at the time a building water connection permit is issued for connection to the municipal water system of the Township of Livingston.

A. 
Service laterals.
(1) 
All service laterals from the curb stop or shut-off valve in the Township right-of-way to the meter shall be the sole responsibility of the property owner. Repairs of service laterals from the curb stop or shut-off valve in the Township right-of-way to the meter shall be completed under the direction of the Township Engineer's office in accordance with current Township standards. All costs shall be borne by the property owner.
(2) 
In the case of a leaking service lateral, the property owner shall be required to repair said service lateral leak within 48 hours. If no arrangements have been made to repair leakage within the time prescribed herein, the Township shall be permitted to retain a contractor to complete the work for a cost of time and materials, which cost shall be the responsibility of the property owner and shall be collected as permitted by law. Restoration of lawn areas, shrubs, fences, walkways, driveways, steps, etc., shall be the sole responsibility of the property owner and not considered as part of the contractor's time and material costs.
(3) 
The installation of a service lateral, either new construction or replacement of the existing lateral shall be the responsibility of the property owner and shall be completed under the direction of the Township Engineer's office in accordance with current Township standards. All costs for service lateral installation from the meter to the water main wet tap shall be borne by the property owner. When the plumbing code requires a change in the size of a service lateral, the property owner is responsible for upgrading the service lateral from the meter up to, and including, the water main wet tap and abandoning the old service at the corporation.
B. 
Excavations.
(1) 
Whenever it shall be necessary to excavate any road under the jurisdiction of the Township for the purpose of making a connection with a water main, such excavation and the backfilling thereof, as well as the temporary and permanent patching of the roadway, shall be done and performed by the property owner, at the cost and expense of such property owner, and in accordance with applicable ordinances and regulations of the Township.
(2) 
Whenever it shall be necessary to excavate any road under the jurisdiction of the County of Essex or the State of New Jersey, application shall be made by the property owner to the appropriate county or state agency for that purpose.
A. 
Requirement. Any person who shall be required, by virtue of any ordinance of the Township or by virtue of any contract, agreement or undertaking entered into between such person and the Township, to lay or construct any water main, pipe or conduit for the supplying of water for domestic or manufacturing or other uses, and who shall lay or construct any such water main, pipe or conduit, shall, before connecting the same, or causing the same to be connected, with the potable water system of the Township, disinfect such water main, pipe or conduit, at his own cost and expense, in accordance with, and in the manner described in the Standard Specifications of the Township of Livingston.[1]

B. 
Supervision and inspection. The process of disinfection of any such water main, pipe or conduit, as required by Subsection A, shall be done under the supervision of, and subject to the inspection by, the Health Officer.
C. 
Testing laboratory report. Upon completion of the process of disinfection, and before any such water main, pipe or conduit shall be connected with the potable water system of the Township, there shall be furnished and delivered to the Health Officer, by the person who laid or constructed such water main, pipe or conduit, a report of an independent testing laboratory, approved by the Department of Health of the State of New Jersey, certifying that samples of the water in such water main, pipe or conduit have been duly tested and analyzed, the results of such tests and analyses, and the conclusion of the person signing such certificate as to the purity and potability of the samples.

Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $2,000, or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
