[HISTORY: Adopted by the Board of Commissioners of the Township of Long Beach 8-2-1974 as § 3-16 of the 1974 Code. Amendments noted where applicable.]
All persons operating any motor or other boats in or upon any of the waters within the territorial limits of the Township, shall so navigate the boats or vessels at a careful and prudent speed and not greater or lesser than is reasonable and proper, having due regard to other navigation, harbor and channel conditions and any other conditions then existing in the immediate waters. No person shall operate a boat or vessel at such a speed as to endanger the life, limb or property of any person.

A. 
Every motor or other boat anchored or moored in the waters within the territorial limits of the Township shall be moored or anchored upon the waters and in such a manner as not to damage any docks, piers, or wharves lawfully placed on the waters within the territorial limits of the Township.
B. 
No motor or other boat shall be anchored or moored within 300 feet of any public beach, public park, public dock or pier, or public street-based launch areas for boats, paddleboards, kayaks, windsurfers, and related water-recreational activities.
C. 
No person shall anchor, moor, or otherwise place or station any wreck or abandoned boat of any kind or nature or any other movable or immovable object of similar nature in or upon the waters within the territorial limits of the Township.
D. 
In the event that any motor or other boat is anchored, moored, or otherwise abandoned in violation of this Chapter and the owner/operator fails to move the boat outside of the prohibited zone after verbal request and direction, the boat poses an obstruction to persons or other boats, and/or the boat poses a threat to the public health, welfare, and safety, the boat may be removed at the direction and order of the Police Department. Removed boats shall be taken or towed to a holding area or location as determined by the Police Department. The owner/operator of the boat shall be responsible for and pay all towing/removal charges and storage costs incurred by the Township and/or any contractor or agent engaged to remove the boat. Those charges and costs shall be paid by the owner and/or operator or other responsible party prior to the boat being released. This power and authorization to have the boat removed is in addition to the other penalties provided by this chapter.
A. 
All boats or vessels propelled in whole or in part by gas, gasoline, naphtha or diesel fuel, burned or consumed in an engine, while being operated, driven or propelled on any of the thoroughfares or waterways lying within the territorial limits of the Township, shall be equipped and provided with an efficient muffler, so constructed and used as to muffle in a reasonable manner and to a reasonable extent the noise of the explosion. All such boats or vessels exceeding five horsepower while being operated shall be equipped and provided with an efficient underwater exhaust or muffler.
B. 
It shall be unlawful for the driver of any boat or vessel or any occupant thereof to operate the cutout or opening of any muffler upon the engine of any boat or vessel while standing or being operated, driven or propelled on any of the thoroughfares or waterways lying within the limits of the Township.
The following shall be prohibited upon the shorefront and upon all waters within the Township:
A. 
The dumping of garbage, food waste, offal or any other waste or sewage materials into any of the waters in the Township.
B. 
The deposit or discharge of oil, grease and other refuse and waste matter in catch basins or in drains so that it will enter catch basins in the Township.
C. 
The discharge of sewage, garbage, motor oil and other waste matter from any boat while anchored or moored in any harbor within 100 feet of land or within 100 feet of any wharf, pier or dock in the Township.

Hereinafter it shall be unlawful to anchor, tie up or permit any houseboat or other vessel occupied or used as a dwelling place or living quarters for one or more persons, to remain for more than 24 hours continuously within or upon the waters of the Bay within the territorial limits of the Township of Long Beach.
The provisions of this chapter are subject to the Navigation Laws of the State of New Jersey, and where any provisions of this chapter are in conflict with the Navigation Laws of the State of New Jersey, the laws of New Jersey shall control.

A violation of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article III, General Penalty.
