This chapter shall be known and may be cited as the "Land Subdivision Chapter of the Township of Long Beach."
The purpose of this chapter shall be to provide rules, regulations and standards to guide land subdivision in the Township of Long Beach in order to promote the public health, safety, convenience and general welfare of the municipality. It shall be administered to ensure the orderly growth and development, the conservation, protection and proper use of land and adequate provision of circulation, utilities and services.

The approval provisions of this chapter shall be administered by the Planning Board of the Township of Long Beach in accordance with the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq., as amended and supplemented.
As used in this chapter, the following terms shall have the meanings indicated:
DRAINAGE RIGHT-OF-WAY
The lands required for the installation of stormwater sewers or drainage ditches or along a natural stream or watercourse for preserving the channel and providing for the flow of water therein to safeguard the public against flood damage in accordance with N.J.S.A. 58:1A.

FINAL APPROVAL
The official action of the Planning Board taken on a tentatively approved plat after all requirements, conditions and engineering plans have been completed and the required improvements have been installed or bonds properly posted for their completion.
FINAL PLAT
The final map of all or a portion of the subdivision which is presented to the Planning Board for final approval in accordance with these regulations and which, if approved, shall be filed with the County Clerk.
LOT
A parcel or portion of land separated from other parcels or portions by description as on a subdivision or record of survey map or by metes and bounds for purpose of sale, lease or separate use.
MASTER PLAN
The duly adopted Master Plan of Long Beach Township, with the various amendments and supplements thereto.
MAJOR SUBDIVISION
Any division of land which is capable of being subdivided into four or more lots.

MINOR SUBDIVISION

A. 
Any division of land for the creation of not more than three lots, each fronting upon and providing vehicular access to an existing, improved street or an existing or permitted new easement, which;
(1) 
Does not involve any new street or the installation of any street improvements or the extension of township facilities;
(2) 
Does not involve any streets requiring additional right-of-way width as specified in the Master Plan or Official Map and/or the street requirements of this chapter, unless such additional right-of-way width, either along one or both sides of said street(s), as applicable, shall be deeded to the township or to the appropriate governmental authority.
B. 
Any readjustment of lot lines resulting in no new lots shall be classified as a "minor subdivision" for purposes of the application and review requirements specified in this chapter, but not for the purposes of counting the number of minor subdivisions occurring within any calendar year.
C. 
Minor subdivisions shall be subject to the limitations imposed by the definition of minor subdivision in N.J.S.A. 40:55D-5.

PERFORMANCE GUARANTY
Any security, which may be accepted by the Township, including but not limited to surety bonds, letters of credit under certain circumstances provided by law, and cash.

PLAT
The map indicating the proposed layout of the subdivision which is submitted to the Secretary of the Planning Board or the Land Use Board Engineer for Planning Board consideration and approval. All plats shall meet the requirements of Article III of this chapter and the Municipal Land Use Law, N.J.S.A. 40:55D-1 et seq.

STREET
Any street, avenue, boulevard, road, lane, parkway, viaduct, alley or other way which is an existing state, county or municipal roadway, or a street or way shown upon a plat heretofore approved pursuant to law or approved by official action or a street or way on a plat duly filed and recorded in the office of the County Clerk prior to the appointment of a Planning Board and the grant to such a Board of the power to review plats, and includes the land between the street lines, whether improved or unimproved, and may comprise pavement, shoulders, gutters, sidewalks, parking areas and other areas within the street lines.
SUBDIVISION
The division of a lot, parcel or tract of land into two or more lots, sites or other divisions of land for the purpose, whether immediate or future, of sale or building development, except that the following divisions shall not be considered subdivisions, provided that no new streets or roads are involved: divisions of property by testamentary provisions or intestacy or divisions of property upon court order. "Subdivision" also includes resubdivision and, where appropriate to the context, relates to the process of subdividing or to the lands or territory divided.
TENTATIVE APPROVAL
The official action taken on a plat by the Planning Board meeting in regular session which determines whether or not the map submitted is in proper form and meets the established standards adopted for design layout and development of the subdivision. Such tentative approval confers certain irrevocable rights as set forth in N.J.S.A. 40:55D-49.
