The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138 any other New Jersey statute or as hereinafter provided.
A. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Police Chief or, in his or her absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, fires, public celebrations, etc., dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal, before regaining possession of the vehicle.
C. 
The effectiveness of this section is contingent upon signs being erected as required by law.

No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I (§ 189-23), attached to and made a part of this chapter nor shall any person park a vehicle at anytime upon any of the streets or parts thereof described in any resolution duly adopted by the governing body of the Township of Long Beach pursuant to § 189-26 of this chapter.
No person shall park a vehicle between the hours specified in Schedule II of any day, from May 1 in any year through September 30, upon any of the streets or parts of streets described in Schedule II (§ 189-24), attached to and made a part of this chapter.
A. 
No person shall park a vehicle at any time on the cul-de-sac portion of the streets described in Schedule III (§ 189-25), attached to and made a part of this chapter.
B. 
For purposes of this chapter, "cul-de-sac" is defined as that portion of the roadway extending beyond that point at which the road edges or curbs cease to be parallel.

No person shall park a vehicle at any time on any easement which is utilized for access, ingress or egress to and from any public street by the owners of any lots fronting on such easement.

A. 
It shall be unlawful to park any motor vehicle on any public street in the Township within 100 feet of any street-end barricade at the ocean or bay or within 100 feet of any barricade installed at and marking the actual physical end of an improved street. It shall be unlawful to park any motor vehicle on any public street in the Township beyond a clearly marked sign identifying a physical street end and instructing NO PARKING BEYOND THIS POINT.
B. 
It shall be unlawful to park any motor vehicle on any public street in the Township in a manner that blocks or obstructs any portion of a public beach entrance to a beach.

No person shall park a vehicle between certain days, in the following areas designated below:
A. 
The parking of motor vehicles shall be prohibited on the easterly sides of all public streets or avenues running generally north and south and on the southerly sides of all public streets or avenues running generally east and west, beginning at the hour of 9:00 a.m. Wednesday and ending at the hour of 9:00 a.m. Sunday:
(1) 
In that section of the Township lying south of the southerly boundary line of the Borough of Beach Haven, and from the northerly curbline of 31st Street in that section of the Township known as "Brant Beach" on the north, extending to the southerly curbline of Ohio Avenue in that section of the Township known as "Beach Haven Terrace" on the south.
(2) 
Coast Avenue in Loveladies, as it is extended in a generally eastwardly direction from Long Beach Boulevard to the end of Coast Avenue; also, Art's Lane, Station Avenue and Guard Avenue in Loveladies for their entire length; 87th Street, in Loveladies, as it is extended in a generally eastwardly direction from Long Beach Boulevard to the end of 87th Street; also, Loveladies Lane, Seaview Drive North and Seaview Drive South for their entire length.

B. 
In the same areas, the parking of motor vehicles shall be prohibited on the westerly sides of all public streets or avenues running generally north and south and on the northerly sides of all public streets and avenues running generally east and west beginning at the hour 9:00 a.m. Sunday and ending at the hour of 9:00 a.m. Wednesday.
C. 
Excepted from Subsections A and B above shall be those streets, or portions of streets, that may be listed in Schedules I, II or III as having a more stringent parking regulation. Such exception shall be applicable only during the time periods of the more stringent regulation.

A. 
It shall be unlawful to park any motor vehicle on the tennis court, basketball court, pickle ball court spaces so owned and designated unless said person is actively engaged in using the courts.
B. 
Four parking lot spaces located at the Municipal Building shall be limited to fifteen-minute parking for persons doing business in the Municipal Building.

The streets or parts of streets described in Schedule V (§ 189-27), attached to and made a part of this chapter are hereby designated as one-way streets in the direction indicated.

Members of the Police Department are hereby authorized to remove a vehicle from a street or a highway to the nearest garage or any other place of safety or to a parking area maintained by the Police Department under the circumstances hereinafter enumerated:
A. 
When any vehicle is left unattended upon any street where such vehicle constitutes an obstruction of traffic.
B. 
When a vehicle upon a street is so disabled as to constitute an obstruction to traffic and the person in charge of the vehicle is by reason of physical injury incapacitated to such an extent as to be unable to provide for the vehicle's custody or removal.
C. 
When any vehicle is left unattended upon any street or public parking lot, which parking lot closes after 8:00 p.m., or in a violation of any municipal ordinance.
D. 
When any vehicle is left unattended upon a street and it is necessary for the public welfare and safety to have said vehicle removed in an emergency in order for the municipality to properly remove snow from said street.

If an officer removes a vehicle from a street as authorized herein, and the officer is able to ascertain the name and address of the owner thereof, such officer shall immediately give notice in writing to such owner of the removal and the reasons therefor and the place to which the vehicle has been removed.

The owner of any such vehicle which has been removed from a street or public parking lot and impounded as above shall be responsible for all towing charges and storage charges to the municipality and/or garage where such vehicle is impounded; provided, however, that the charges shall not exceed the current average rate for towing and storage.

Trucks over four tons gross weight are hereby excluded from the streets or parts of streets described in Schedule VI (§ 189-28A), except for the pickup or delivery of material on such streets. Low-speed vehicles, as defined in Chapter 273, § 1, of the Laws of 2005 (N.J.S.A. 39:1-1), are hereby expressly excluded from the streets described in Schedule VI (§ 189-28B).

A. 
Statutory authority. Pursuant to N.J.S.A. 52:32-11, 52:32-12 and 39:4-197, this section provides for restricted parking spaces for handicapped persons in all parking facilities under the jurisdiction of the Township of Long Beach.
B. 
As used in this section, the following terms have the following meanings:
PHYSICAL HANDICAP
A physical impairment which confines a person to a wheelchair, causes a person to walk with a difficulty or insecurity, affects the sight or hearing to the extent that a person functioning in public areas is insecure or exposed to danger, causes faulty coordination or reduces mobility, flexibility, coordination and perception to the extent that facilities are needed to provide for the safety of that person.
PUBLIC BUILDING
Any building, structure, facility or complex used by the general public or to which the general public is invited, including but not limited to theaters, concert halls, auditoriums, museums, schools, libraries, recreation facilities, factories, office buildings, businesses, shopping centers, hotels or motels, public eating places, whether privately or publicly owned, except that this terms shall not include private family residences, warehouse storage areas and all buildings conducting hazardous occupancies that involve highly combustible, highly flammable or explosive materials.
C. 
Owners to provide spaces. The owners of all public buildings which provide parking spaces adjacent to or used in conjunction with the public building shall, within 90 days of notice thereof, provide for parking spaces for handicapped persons in accordance with the guidelines herein set forth and in a location and manner as determined by the Code Enforcement Officer.
D. 
Construction guidelines. Parking spaces for the physically handicapped shall be constructed in accordance with the following guidelines. In all instances where parking lots are provided for public buildings or facilities as defined herein, designated parking spaces for handicapped persons shall be required as follows:

E. 
Handicapped parking on public streets. The locations described in Schedule VII (§ 189-29), are hereby designated as restricted parking spaces for use by persons who have been issued special vehicle identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces. Such areas shall be marked with a clearly visible sign displaying the international symbol of access penalty sign and, where adjacent curb exists, shall be painted in fluorescent yellow paint the length of the handicapped space.

A. 
No person shall park a vehicle in a parking space designated and marked as being set aside for the physically handicapped in any parking facility unless said vehicle shall have affixed thereto an identification certificate or marker issued by the New Jersey Director of the Division of Motor Vehicles.
B. 
Parking in a handicapped space without the aforesaid vehicle identification shall create a rebuttable presumption that use of the space was not for the physically handicapped.

Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule VIII (§ 189-30) are herein designated as stop intersections. Stop intersections shall be installed as provided therein.

At all times it shall be unlawful for the operator of any motor vehicle to pass any other motor vehicle traveling in the same direction in the zones designated in Schedule IX (§ 189-31).

No person shall make a turn at any location listed in Schedule X (§ 189-32), and only in the manner prescribed.

A. 
The Chief of Police of Long Beach Township is hereby authorized to issue orders closing any street or portion thereof in Long Beach Township to use by motor vehicle traffic when he or she finds that such closure is necessary as the result of public construction projects in the dedicated portion of such street or when he or she finds, working in consultation with the Building Department of the Township of Long Beach, that such closure is required to protect public safety as a result of private construction occurring on any lot or lots abutting the street affected by his or her closure order.
(1) 
Any closure order may contain provisions which the Chief may deem necessary and appropriate in order to protect and preserve public safety during the term of closure providing for the posting of appropriate traffic control signs, devices and signage, which signs, devices and signage, are directed to accomplish the safe and expeditious movement of traffic through and around the closure area in order to provide safety for the work forces performing the operations requiring the closure as well as to provide safety for the public. Any signs, devices and signage shall comply with the mandates of the Manual on Uniform Traffic Control Devices for Streets and Highways.
(2) 
In addition to signage as authorized in Subsection A(1) above, the Chief of Police may also mandate the employment by the party applying for closure to employ such number of off-duty police officers of the Township of Long Beach at the applicant's sole cost and expense as may reasonably be necessary to insure safety of the road during all or any part of the term of closure.
B. 
Any order issued by the Chief of Police for the closing of any street or a portion thereof which will result in a closure for a period of more than 48 consecutive hours shall be approved, in advance, by the Director of Public Affairs and Public Safety of the Township of Long Beach.
C. 
Any motor vehicle used or to be used in any construction project subject to the regulations set forth in § 64-16 of the Code of Long Beach Township where a closure order issued by the Long Beach Township Chief of Police is required which is parked in the street where a closure order is required prior to the issuance of such a closure order shall be deemed a nuisance and a danger to the safe and proper flow of traffic and any Long Beach Township Police Officer may cause the removal and impoundment of such vehicle. The owner of any such vehicle so impounded shall bear the reasonable costs of removal and storage prior to regaining possession of the vehicle.
D. 
Any person, firm, corporation or other entity wishing to conduct work on, under or above any street in Long Beach Township which may require a closure order issued by the Chief of Police as provided for in this section shall contact the Police Department of Long Beach Township in order to arrange a preconstruction meeting at which meeting the person, firm, corporation or other entity shall submit to the Police Department proposed plans for the safe movement of traffic during such period of construction or work which requires a closure order and no closure order shall be issued and no work may be commenced prior to the issuance of such closure order until after the Chief of Police of Long Beach Township or the Chief's designated representative shall have approved the proposed plans.
(1) 
The person, firm, corporation or other entity shall provide at the preconstruction meeting two emergency contact telephone numbers to be called in the event of an emergency at the construction site, which construction required the closure order. If emergency contact is necessary and immediate response is not provided, the Township of Long Beach may respond to correct any hazardous conditions causing the emergency call and the reasonable costs for such correction shall be charged to the person, firm, corporation or entity responsible for the construction area.
E. 
With the exception of emergency conditions, no work shall be performed on any construction site which is subject to a closure order issued or to be issued by the Long Beach Township Chief of Police except in conformity with the hours set forth in § 123-6B(2) and (3) of the "Code of the Township of Long Beach, County of Ocean, State of New Jersey, (1997).”
F. 
No preconstruction activities may commence, except for emergent situations, at any construction site which is the subject of a road closure order by the Chief of Police of the Township of Long Beach until all requisite construction signage, light devices and requisite pavement markings have been installed. The prohibited preapproval activities include deposit of materials, parking of vehicles and equipment and the like.
G. 
Any closure order issued by the Chief of Police of Long Beach Township shall have a copy of such order filed with the office of the Municipal Clerk of Long Beach Township no less than 24 hours prior to the effective date of such closure notice; provided, however, that in the event of an emergency closure, the closure notice may be filed with the Municipal Clerk's office as soon as the same may practically be done after the issuance of the closure order.
H. 
The Chief of Police may designate a subordinate from the Traffic Safety Unit to issue the closure orders provided for in this section in his absence. The designated officer may also act in lieu and instead of the Chief of Police in issuing closure orders when so authorized by the Chief of Police.
I. 
No Long Beach Township public street may be closed, except in cases of emergencies, except pursuant to the terms and provisions of this section.

The streets or parts of streets described in § 189-34, Schedule XI: Speed Limits, shall have the speed limits designated in such schedule.
