A certain document, a copy of which is on file in the Municipal Construction Code Office of the Borough of Longport, being marked and designated as the International Property Maintenance Code, 2003 Edition, as published by the International Code Council, Incorporated, be and is hereby adopted as the Property Maintenance Code of the Borough of Longport, State of New Jersey, for the control of properties, buildings, and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions, and terms of said Property Maintenance Code are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, deletions, and changes, if any, prescribed in § 133-2 of this chapter and as may be elsewhere stated in said chapter.
The following sections of the Property Maintenance Code are hereby revised:
A. 
In Section 101.1, insert "Borough of Longport."
B. 
In Section 103.5, insert "N/A."
C. 
In Section 302.4, insert "10 inches."
D. 
In Section 304.14, insert "May 15 to October 1."
E. 
In Section 602.3, insert "October 1 to May 1."
F. 
In Section 602.4, insert "October 1 to May 1."
A. 
Any person violating this chapter shall, upon conviction thereof, be punishable by one or more of the following: a period of community service not exceeding 90 days; a fine of not less than $100 nor more than $1,250 at the discretion of the presiding Judge.
B. 
Any person who is convicted of violating the provisions of this chapter within one year of the date of the previous violation of the same chapter and who was fined for the previous violation shall be sentenced by the court to an additional fine as a repeat offender. The additional fine imposed by the court for a repeated offense shall not be less that the minimum or exceed the maximum fine fixed for a violation of this chapter, but shall be calculated separately from the fine imposed for the original violation of this chapter. Whenever such person shall have been officially notified or by service of a summons in a prosecution, or in any other official manner, that said person is committing a violation, each day's occurrence shall constitute a separate offense, punishable by a fine or penalty.
The Construction Code Official or his designee and/or the Borough Zoning Officer are hereby designated as the Officer(s) to exercise the powers prescribed by this chapter.
