[HISTORY: Adopted by the Township Committee of the Township of Mansfield 12-10-1997 by Ord. No. 1997-14. Amendments noted where applicable.]
The Township Committee of the Township of Mansfield hereby recognizes the Franklin Fire Company as the volunteer fire company authorized to perform fire-fighting functions and duties on behalf of the Township of Mansfield.
The members of the fire company shall be under the supervision and control of the Township and, in performing fire duties, shall be deemed to be exercising a governmental function. However, the appointment or election of the Chief of the volunteer fire company and the officers of the department shall remain the prerogative of the membership of the fire company as set forth in the company's certificate of incorporation or bylaws.
The Township hereby delegates to the Chief of the Fire Department, as selected by the membership thereof, the authority and responsibilities of directing fire-fighting activities for the Department.
The Township shall be authorized to provide funding to the Franklin Fire Company in accordance with the provisions of N.J.S.A. 40A:14-34.
In the event that any clause, section or paragraph of this chapter is deemed to be invalid for any reason, then it is hereby declared to be the intent of the governing body that the balance of the chapter shall remain in full force and effect, the governing body hereby declaring that it would have adopted the remainder of the chapter even without the offending provision.
Any and all ordinances inconsistent with the provisions of this chapter be and the same are hereby repealed to the extent of any such inconsistencies.
This chapter shall become effective upon proper passage in accordance with the law.
