No person shall sell any alcoholic beverages in the borough without
first obtaining a license for that purpose.
The Mayor and Council, being the governing body of the municipality,
shall constitute the authority to administer the issuance of licenses under
this article.
The classes of licenses to be issued by the borough are hereby fixed
as follows:
A. Plenary retail consumption licenses.
B. Seasonal retail consumption licenses.
C. Plenary retail distribution licenses.
The maximum number of plenary retail consumption and plenary retail
distribution licenses to be issued and outstanding at the same time under
this article shall be as follows:
A. Plenary retail consumption licenses: four.
B. Plenary retail distribution licenses: four.
The annual fees for licenses shall be as set forth in Chapter
169, Fees.
During the hours that sales are prohibited by §
110-7, the entire licensed premises shall also be closed. This requirement shall not apply to motels and hotels, restaurants as defined in N.J.S.A. 33:1-1t or clubs as defined in N.J.S.A. 33:1-12, Subdivision 5. However, clubs shall be closed on Sundays between the hours of 2:00 a.m. and 8:00 a.m., except as provided in §
110-7A.
No licensee shall allow, permit or suffer in or upon the licensed premises
any disturbances, lewdness, immoral activities, brawls or unnecessary noises
nor allow, permit or suffer the licensed place of business to be conducted
in such manner as to become a nuisance.
No plenary retail consumption license or seasonal retail consumption
license, except renewals for the same premises and transfers of licenses from
person to person within the same premises, shall be granted or transfer made
to other premises within a distance of 400 feet from any other premises then
covered by any other plenary retail consumption license or any seasonal retail
consumption license.
In addition to the penalties provided in §
110-13, the license issued pursuant to this article may be suspended or revoked for violation of any provision of this article or for violation of any provision of Chapter
1 of Title 33 of the Revised Statutes or of any of the rules and regulations promulgated by the Director of the Division of Alcoholic Beverage Control.
Any person who violates any provision of this article shall, upon conviction
thereof, be punished by a fine not exceeding $1,000 or by imprisonment for
a term not exceeding 90 days, or both.
