A soil erosion and sediment control plan shall
be approved by the Planning Board or Board of Adjustment prior to
site plan approval, preliminary subdivision approval, conditional
use, zoning variance, planned unit development or construction permit,
as the case may be.
The soil erosion and sediment control plan or
any major amendment shall be approved by the Planning Board in the
manner and form according to the regulations hereinafter set forth.
The Planning Board, in approving said soil erosion and sediment control
plan, may impose lawful conditions or requirements designated or specified
on or in connection therewith and may require that such conditions
or requirements, and the satisfaction thereof, be made a part of all
improvements and maintenance agreements to be executed with the Township,
and the securities to be posted in connection therewith. These conditions
and requirements shall be provided and maintained as a condition to
the establishment, maintenance and continuance of any use or occupancy
of any land or structure thereon.
Amendments to a soil erosion and sediment control
plan required as the result of conditions arising in the field during
construction may be approved by the Township Engineer upon written
request to him, and such approval as may be given by said Engineer
shall be communicated in writing by the Engineer to the Planning Board,
notifying the Planning Board of the nature and reason for the change.
In the event of a failure to comply with any
condition of the soil erosion and sediment control plan, the Township
Engineer or Construction Official shall cause the revocation of the
building permit or the certificate of occupancy, as the case may be,
and seek to enjoin the violation, or take such steps looking to the
enforcement of any such condition as may be lawful.
A formal report of compliance with the provisions
of a certified plan for permanent measures to control soil erosion
and sedimentation must be filed with the municipal agent authorized
to issue certificates of occupancy. A copy of this report shall be
sent to the Morris County Soil Conservation District.
