There is hereby established a Department of Community Development in the Township of Mount Laurel, County of Burlington, State of New Jersey.
The head of said Department shall be appointed by the Manager and subject to the direction and supervision of the Manager.
A. 
Within said Department shall be the office of the Mount Laurel Housing Official, who shall be appointed by the Manager and subject to the direction and supervision of the head of the Department of Community Development.
B. 
Said Housing Official shall be responsible for the administration and various required determinations necessary for the sale and resale of low- and moderate-income housing consistent with the rules and regulations of the Township of Mount Laurel which have been or will be promulgated, adopted and amended and supplemented from time to time by the Mayor and Township Council and approved by the court-appointed Master.
The governing body may, as an alternative to the appointment set forth in § 4-58.3, contract for the administration of this Article with respect to low- and moderate-income housing with either a responsible nonprofit corporation or agency of the county or state government which is qualified to provide this service.
The duties of the Housing Official shall include but not be limited to the following:
A. 
To administer the rules, regulations and procedures established by the Township of Mount Laurel for qualification and determination of eligible occupants.
B. 
Review the prequalification and predetermination of eligible occupants made by any developer or inclusionary housing.
C. 
To make determinations of eligibility of occupants of low-and moderate-income housing based upon documentation submitted through the developer of such inclusionary housing as to the qualification of the potential buyer or lessee of the unit, based upon such potential purchaser or lessee's income and any other criteria set out in the rules and regulations.
D. 
To make determinations that the sales price or rental price does not exceed the ceiling established.
E. 
To make determinations that the household is of the appropriate size for the unit to be occupied.
F. 
To keep copies of all applications and approvals on file.
G. 
To maintain a list of low- and moderate-income households that seek to acquire low- and moderate-income housing.
H. 
Upon the advice of the Master, to issue certifications permitting an increase in the income ceiling of an eligible purchaser if prospective purchasers cannot be found for resales.
I. 
To certify the price of a resale unit based upon documentation submitted.
J. 
To administer the township downpayment assistance program as defined by court order.
K. 
To send to the Township Solicitor for review copies of all covenants proposed by an inclusionary developer, which covenants are to restrict the low- and/or moderate-income unit as such low- and/or moderate-income unit for the period of time set forth in the court order.
L. 
To serve notice of breach upon the owner of any low- and moderate-income units in the event that the township finds that the owner has violated any provision of the consent order or ordinances controlling said housing.
M. 
To administer housing units to which title has been acquired by the township.
N. 
To review and approve written affirmative marketing plans submitted by the developer.
O. 
To calculate affordability guidelines adjusted for family size at such times as there is a change in the periodic income estimates and standard coefficients of the United States Department of Housing and Urban Development for the region encompassing Mercer, Burlington, Camden and Gloucester Counties and make these affordability guidelines to developers and to the public at large.
