A code regulating the manner in which the refuse of and from residential establishments may be stored, and further regulating the manner in which the refuse of and from industrial and commercial establishments may be stored, collected and disposed of; declaring and defining certain conditions as nuisances; fixing the responsibilities of persons storing refuse at residential, industrial and commercial establishments and collecting and disposing of refuse from industrial and commercial establishments; and providing for the issuance of permits to collect refuse from industrial and commercial establishments, is hereby established pursuant to the provisions of P.L. 1950, c. 188.[1] A copy of said code is annexed hereto and made a part hereof without the inclusion of the text thereof herein.

The said code established and adopted by this Article is described and commonly known as the "Solid Waste Code of New Jersey (1959)."
Three (3) copies of the said Solid Waste Code of New Jersey (1959) have been placed on file in the office of the Secretary of the Board of Health of the Township of Mount Laurel upon the introduction of this Article and will remain on file there until final action is taken on this Article for use and examination by the public.
No person, firm or corporation shall:
A. 
With respect to all establishments, whether residential, industrial or commercial, fail or neglect to comply with the provisions of the said code entitled "Section 2, Refuse Receptacles," and "Section 3, Preparation of Refuse for Collection."
(1) 
With respect to residential establishments, in addition to the types of refuse receptacles permitted by the terms of the said code, the occupant may use plastic bags which are designed for refuse and garbage disposal, provided that said bags are so constructed as to prevent spillage or leakage and are kept tightly secured when in use.
B. 
With respect to industrial and commercial establishments, fail or neglect to comply with all sections of the code adopted hereby.
C. 
With respect to industrial and commercial establishments, conduct or engage in the business of collecting or disposing of solid waste without having first procured a permit to do so or without complying with the provisions of the code hereby adopted.
D. 
With respect to residential, industrial or commercial establishments, burn or cause or suffer to be burned any refuse, including leaves, papers or other goods or articles of whatever form or nature.
E. 
With regard to industrial and commercial establishments, store or suffer to be stored refuse which shall prove to be incapable or impracticable of storage in accordance with the provisions of Section 2, Refuse Receptacles, of the said code in other than a covered or enclosed area of adequate design to prevent the blowing about and other relocation of refuse.
Jurisdiction to hear complaints of a violation of this Article and to impose the penalties hereinafter prescribed shall be vested in the Municipal Court of the Township of Mount Laurel.
Upon notice to him that any person, firm or corporation granted a permit under this Article shall have violated the provisions thereof, the Sanitarian may, by complaint filed in the Mount Laurel Township Municipal Court, institute proceedings in the name of the Board of Health of the Township of Mount Laurel for the enforcement and imposition of the penalties hereinafter prescribed.

Any person, firm or corporation having been found guilty of a violation of the provisions of this Article shall, upon complaint made pursuant to the provisions of the foregoing § 85-6, for each violation, be penalized not less than two dollars ($2.) and not more than one thousand dollars ($1,000.) per day per violation, which penalty shall be paid to the Court and delivered to the treasurer of the Township of Mount Laurel, or by a period of community service not exceeding ninety (90) days.
