This Article is adopted for the protection and promotion of the public
health, safety and general welfare of the community by regulating the storage
of garbage and other waste materials as well as the use, maintenance and operation
of bulk garbage containers referred to as "dumpsters."
As used in this Article, the following terms shall have the meanings
indicated:
Residue from fires used for cooking and heating and on-site incineration.
A bulk storage container for garbage and other waste materials that
can be hauled directly to the point of disposal or emptied into a large compactor-type
truck or other conveyance for disposal.
Wastes from the preparation, cooking or serving of foods; market
wastes; and wastes from the handling, storage and sale of produce.
Includes all categories of materials to be disposed of, excluding
garbage.
The property owner, lessee or user of the container shall make provisions
to have the collection from the dumpster on such a schedule so that the garbage
and other waste materials do not accumulate so as to overflow the confines
of the container or restrict the closing of the container cover, if any.
A.
The dumpster shall be located within a residential community
as placed upon the final plans of approval for the development of said community,
or as otherwise approved by the Township of Mount Laurel.
B.
No dumpster shall be located in or on a public right-of-way
so as to interfere with the flow of traffic.
C.
Garbage and other waste materials must be completely
contained within the dumpster. No accumulation of garbage or waste materials
will be permitted outside the confines of the dumpster, nor will it be permitted
to accumulate garbage or other waste materials so that the dumpster cover
cannot be firmly closed.
D.
All dumpsters shall be kept in good repair, be structurally
sound, be leakproof and be easily opened and closed. Dumpsters shall be painted
as required to prevent the show of rust and deterioration and be so constructed
as to stand firmly upright.
E.
All dumpsters shall have the name of the company or individual
owning such dumpster clearly printed on either the front or the back of such
dumpster.
F.
The use of the dumpster in any community with a common association which funds the removal of waste, such as but not limited to a condominium or homeowners' association, shall be limited to the people who reside in such community. Unauthorized use of a dumpster by someone ocher than a member of said community shall be considered a trespass as to the penalties of this code and subject to the penalties as contained in § 85-8 hereof.
A.
In the event that the dumpster is owned or placed in
a community for the benefit of the residents of said community, said trash
container should contain upon it, in a location visible to anyone who would
use the container for the purposes for which it was intended, language which
clearly indicates that the dumpster is for the use of the condominium or homeowners
association members only or for residents of the community that it is serving.
The language must be such as to clearly indicate that anyone who uses the
dumpster who is not such a resident is an unauthorized user of such facility.
B.
In the event that said condominium does not post such
a warning as contained in the previous section hereto, such failure shall
not cause said association to be in violation of that section but shall only
affect the enforcement of such against third parties.
Relief from any of the provisions of this Article alleged to be a hardship
may be obtained by submitting, in writing, to the Mount Laurel Township Board
of Health a statement detailing the hardships and relief requested. The Board
of Health shall review the submission, confer with the township fire officials
and thereafter render a decision thereon within thirty (30) days. In the event
that said hardship involves site location of a dumpster, a site plan of the
property shall be submitted, showing the proposed site location of the dumpster,
the distance from the property line or right-of-way and whatever pertinent
information the petitioner may feel will be relevant to his presentation.
