[HISTORY: Adopted by the Board of Health of the Township of Mount Laurel 6-10-1959 as Ord. No. 1959-3BH.[1] Amendments noted where applicable.]

Editor's Note: Pursuant to the adoption of Ord. No. 1971-1, the legislative functions of the former Board of Health are vested in the Township Council. The Council will adopt all amendments to this legislation subsequent to said ordinance.
A code defining and prohibiting certain matters, things, conditions or acts, and each of them, as a nuisance; prohibiting certain noises or sounds; requiring the proper heating of apartments; prohibiting lease or rental of certain buildings; prohibiting spitting in or upon public buildings, conveyances or sidewalks; authorizing the inspection of premises by an enforcing official; providing for the removal or abatement of certain nuisances and recovery of expenses incurred by the Board of Health of Mount Laurel Township[1] in removing or abating such nuisances; and prescribing penalties for violations, is hereby established pursuant to Chapter 188, Laws of 1950.[2] A copy of said code is annexed hereto and made a part hereof without the inclusion of the text thereof herein.

The said code established and adopted by this chapter is described and commonly known as the "Public Health Nuisance Code of New Jersey (1953)."
Three copies of the said Public Health Nuisance Code of New Jersey (1953) have been placed on file in the office of the Clerk of this local Board of Health[1] upon the introduction of this chapter and will remain on file there for use and examination by the public.

The provisions of Section II(e), (f), (g), (h) and (i) of the aforesaid Public Health Nuisance Code of New Jersey (1953), identified in § 165-3 hereof, shall not apply to farmers. For the purposes of this section, a "farmer" is defined as one who owns, leases or occupies a tract of land of over five acres and whose principal income is derived from farming.

It shall be unlawful for any person, firm or corporation to release, organize the release, or cause to be released balloons inflated with a gas that is lighter than air within the Township of Mount Laurel limits, except for:
A. 
Balloons released by a person on behalf of a governmental agency or pursuant to a governmental contract for scientific or meteorological purposes.
B. 
Hot air balloons that are recovered after launching.
C. 
Balloons released indoors.

Any person who violates or neglects to comply with any provision of this chapter or code established herein or notice issued pursuant thereto shall, upon conviction thereof, be liable to a penalty of not less than $10 nor more than $1,000 for each violation.
