The use of all sanitary sewers of the Borough of Hasbrouck Heights shall be in compliance with the rules and regulations enacted by the Bergen County Utilities Authority.

The Borough of Hasbrouck Heights hereby adopts and enacts the user charge system and industrial cost recovery system contained in the rules and regulations of the Bergen County Utilities Authority and authorizes their immediate implementation by the appropriate municipal official; provided, however, that nothing contained herein shall authorize or impose on the Borough of Hasbrouck Heights or on any property owner or taxpayer thereof any tax by the Bergen County Utilities Authority, and any cost or charge by virtue of said user charge system and industrial cost recovery system shall be paid and satisfied out of the annual charge imposed on the Borough of Hasbrouck Heights by the Bergen County Utilities Authority pursuant to its present contract with the Borough and any amendments thereto; provided, further, that any additional charge or expense other than those under the user charge system and industrial cost recovery system to be hereafter imposed on the Borough of Hasbrouck Heights or any property owner or taxpayer thereof shall only be effected by a duly adopted ordinance of the Borough of Hasbrouck Heights specifically supplementing and amending this article to such extent.

Any provision contained in § 222-39 of this article to the contrary notwithstanding,[1] there is hereby adopted the current Tier II Sanitary Sewer User Charge System of the Bergen County Utilities Authority in respect to premises identified by the said Authority as "significant industrial users" but which premises are not otherwise exempt from the imposition of real property taxes. There is hereby authorized the immediate implementation of the same by the appropriate officials of this Borough. Any charge levied hereunder shall be a lien upon the premises to which it is charged to the same effect and created in the same manner as a lien for the payment of real property taxes duly levied by this Borough which may be executed upon in the same manner as a tax lien.

A. 
Not fewer than three copies of the rules and regulations of the Bergen County Utilities Authority have been and are filed in the office of the Clerk of the Borough of Hasbrouck Heights and are available for public inspection during normal business hours.
B. 
Copies of the rules and regulations of the Bergen County Utilities Authority can be obtained from the Bergen County Utilities Authority for the cost of publication.
The Mayor and Clerk of the Borough of Hasbrouck Heights shall be and they are hereby authorized to act as signatories upon and to execute on behalf of the Borough of Hasbrouck Heights an amendment to the existing service agreement with the Bergen County Utilities Authority which embodies the intent and purpose of this article.
