The 2018 edition of the International Fire Code ("IFC"), including
all references and appendices, as published by the International Code
Council, copies of which shall remain on file in the office of the
Clerk of the Village of New Haven, is hereby adopted by reference
as the Village of New Haven Fire Code, in the State of Michigan regulating
and governing the safeguarding of life and property from fire and
explosion hazards arising from the storage, handling, and use of hazardous
substances, materials, and devices, and from conditions hazardous
to life or property in the occupancy of buildings and premises as
herein provided. The issuance of permits and collection of fees and
all regulations, provisions, penalties, conditions and terms of the
IFC on file in the office of the Village of New Haven as referred
to are hereby adopted and made part of this article.
Pursuant to MCLA § 29.31, in the event that any part
of this article is in conflict with the Michigan Fire Prevention Code,
Public Act 207 of 1941, MCLA § 29.1 et seq., then the Michigan
Fire Prevention Code shall control.
All ordinances or resolutions, including specifically Ordinance
No. 224, in conflict with any part of this article are hereby repealed
to the extent of the conflict.
If any part of this article is held invalid or unconstitutional
for any reason, the remaining parts of this article shall remain unaffected.
This article shall take effect 20 days after adoption by the
Village Council, or immediately upon publication, whichever date occurs
first.

This article shall be known and cited as the "Village of New
Haven/Rescue Call Cost Recovery Ordinance."
The purpose of this article is to provide financial assistance
to the Village in the operation of a fire department from those receiving
direct benefits from the fire protection service and to provide recovery
for emergency costs. A significant number of fire/rescue incidents
in the Village involve acts by nonresident individuals, contractors
and/or tax-exempt facilities. There is an increased demand for fire
rescue services beyond regular firefighting, requiring additional
training, certification, licensure and specialized equipment. As a
result, the Village finds that a greater operational and financial
burden is now placed on the Village's fire department by the
actions of and demands for service from non-tax-paying entities. A
further burden is now placed on the Village's fire department
from drivers, operating a vehicle while under the influence of intoxicants
or a controlled substances, who are more likely to cause personal
injury or property damage and require fire/rescue services. This article
is necessary to recover such increased emergency response costs.
This article is adopted pursuant to, and in accordance with,
Public Act 33 of 1951, as amended [Michigan Compiled Law § 41.806(a)
et seq.].
