As used in this article, the following terms shall have the meanings indicated:
OWNER
Any person, firm, partnership, association, corporation, company or organization of any kind.
Any owner of property within an industrial or commercial zoned area, before beginning any construction on said property, shall apply to the Commissioner of Public Works for a permit therefor, and such application shall be accompanied by a plan showing the following:
A. 
Complete details of the property in question.
B. 
Any existing or proposed driveways.
C. 
All buildings or structures on the property or to be erected on said property and their location thereon as standing or to be erected.
D. 
Complete details on sewerage, drainage and all other utilities.
E. 
Location of all sidewalks, walks and curbings, existing and to be proposed.
F. 
Description of all materials to be used in construction of such driveways, sidewalks, walks and curbs.
All applicants shall be held to the following construction responsibilities:
A. 
The applicant shall furnish all materials, including necessary signs and traffic controls, and shall pay all costs for work done in any public way.
B. 
All work done shall meet the requirements and standards set by the City of Fitchburg.
C. 
No work shall be started to alter any existing sidewalk or curbing without a permit therefor from the Commissioner of Public Works.
D. 
All work may be stopped on order of the Commissioner of Public Works if, during an inspection of the work being done, such work is not being done in accordance with the above-mentioned standards.
E. 
The applicant, and his or her heirs, successors and assigns, as a condition of being granted a permit hereunder, shall remain responsible for any and all maintenance that may be necessary as the result of any work done by the applicant.

A. 
Design standards shall comply with the following requirements:
(1) 
General Specifications for the Construction of Bituminous Concrete Sidewalks and General Construction Within the Sidewalk Area, available at the office of the Commissioner of Public Works.
(2) 
General Specifications for Street Construction where applicable, such specifications being available at the office of the Commissioner of Public Works.
(3) 
Specifications for the Installation of Slope Granite Curb, where applicable, such specifications being available at the office of the Commissioner of Public Works.
B. 
If there are no City of Fitchburg specifications applicable to any of the situations which may arise as to such sidewalks and curbs, the Commonwealth of Massachusetts, Department of Public Works Standard Specifications for Highways, Bridges and Waterways, as amended from time to time, shall apply.
C. 
In the event of situations where there are no specifications of either the City of Fitchburg or the Commonwealth of Massachusetts, the Commissioner of Public Works shall have the authority to prepare special specifications as to such situation.
In any case where the applicant hereunder shall fail to comply with the requirements of this article, the Commissioner of Public Works shall order the completion of the work, if same is on a public way, by the City and shall recover the costs thereof from the person obtaining the permit.
The Commissioner of Public Works shall have the authority to require an applicant hereunder to file a bond conditioned to protect and save harmless the City of Fitchburg from all claims for damages and injuries to other persons and property by reason of the work being done hereunder.

All petitions for berm construction must be approved in petition form with the cost of materials to be shared equally by the petitioner and the City, except in such situations where the Commissioner of Public Works deems the responsibility to lie with the City.
