Editor's Note: Bylaw Amendment 85-55, adopted
10-1-1985, provided for the acceptance of MGL C. 40, § 21,
allowing designated parking areas for disabled and handicapped persons
in public and private off-street parking areas.
No person shall allow, permit or suffer any
vehicle under his control or registered in his name to stand or park
in any street, way, highway, road or parkway under the control of
the Town of Franklin in violation of any of the traffic rules or orders
adopted by the Town Council and in particular in any of the following
places, except when necessary to avoid conflict with other traffic
or in compliance with direction of a police officer or traffic sign
or signal:
A.
Within an intersection.
B.
Upon any sidewalk.
C.
Upon a bridge or viaduct.
D.
Upon any crosswalk.
E.
Upon the roadway in a rural or sparsely settled district.
F.
Upon a roadway where parking other than angle parking
is permitted, unless both wheels on the right side of the vehicle
are within 12 inches of the curb or edge of the roadway.
G.
Upon any roadway where the parking of a vehicle will
not leave a clear and unobstructed lane at least 20 feet wide for
passing traffic.
H.
Upon any street or highway within 10 feet of a fire
hydrant.
I.
Upon any street or highway within 20 feet of any intersecting
way, except an alley.
J.
Within 15 feet of the wall of a fire station or directly
across the street from such station, provided that signs are erected
acquainting the driver with such restrictions.
K.
In front of any private road or driveway or opposite
or alongside any street excavation or obstruction when such stopping,
standing or parking would obstruct traffic.

No person shall stand or park any vehicle at any time:
A.
Upon streets or parts thereof where such a prohibition is posted.
B.
At bus stops, except buses, and no person shall park a bus within
a business district at any place other than a bus stop when a nearby
bus stop is available.
C.
At taxicab stands, except taxicabs, and no person shall park a taxicab
upon any street within a business district at any place other than
the taxicab stand or stands designated for the use of his taxicab
or taxicabs, except while engaged or while waiting for an opportunity
to use a taxicab stand designated for his use.
D.
Parking prohibited.

Any vehicle found parked in violation of any
of the provisions of this article may be moved by or under the direction
of an officer and at the expense of the owner to a place where parking
is allowed.

A.
Fire lanes. It shall be unlawful to obstruct or park
a vehicle in any fire lane if designated at a shopping center, hospital,
school, professional building, industrial complex, condominium complex
with designated parking space for 20 or more vehicles or a place of
public assembly. Such fire lanes are to be designated by the Fire
Chief and the Police Department Safety Officer and posted as such.
Said fire lanes are to be a distance of 12 feet from curbing of a
sidewalk in a shopping center, apartment and/or condominium complex
and similar locations. Where no sidewalk with curbing exists, the
distance and location shall be established by the Fire Chief along
with the Safety Officer.
B.
Any object or vehicle obstructing or blocking any
fire lane or restricted area may be removed or towed by the Town under
the direction of a police officer at the expense of the owner and
without any liability to the Town of Franklin.
C.
The owner of record of any building affected by these sections shall provide and install signs and road markings as provided in Subsection A of this section. Said signs and road markings shall comply with the following specifications:
(1)
Signs shall be no less than 12 inches by 18 inches
in size.
(2)
Signs shall be constructed of a rust-resistant metal.
(3)
Signs shall have a white-in-color background with
four-inch red-in-color letters stating "Fire Lane - No Parking - Tow
Zone."
(4)
Any area designated as a fire lane shall be outlined
with yellow painted lines nine inches in width to enclose the fire
lane. Within this designated area, the words "Fire Lane" shall be
painted also in yellow and shall be no less than three feet in height.
(5)
The number of signs and road markings shall be designated
by the Fire Chief and the Safety Officer.
(6)
The owner of record shall have 90 calendar days to
place the road markings and install the signs within the fire lane.
D.
Any person violating any of the foregoing sections
shall pay a monetary fine to the Town of Franklin. The amount of the
fine ($10 to $15) is to be established by the Town Council.
