Any person found to be violating any provision of this chapter, except § 164-40, shall be served by the Town with
written notice stating the nature of the violation and providing a reasonable
time limit for the satisfactory correction thereof. The offender shall, within
the period of time stated in such notice, permanently cease all violations.
Any person who shall continue any violation beyond the time limit provided
for in § 164-44 above shall be subject to civil penalties, not exceeding
$5,000 for each violation.
Any person violating any of the provisions of this chapter shall become
liable to the Town for any expense, loss or damage occasioned the Town by
reason of such violation. The expense, loss or damage shall be taken to be
to the extent determined by a competent registered professional engineer particularly
skilled in the operation and maintenance of wastewater collection and treatment
works.
