A. 
All applications for the opening of public County roads shall be in writing to the County.
B. 
All such applications shall be accompanied with the following:
(1) 
A check from the applicant to pay for the publication expenses; and
(2) 
Plats, surveys and legal descriptions for the new road requested to be opened.
C. 
Should the County Council desire to proceed with the request to open a new County road, the County Council shall schedule a public hearing on the matter, with notice of the date, time and place of the public hearing by publication once a week for two successive weeks in a newspaper of general circulation in Dorchester County.
D. 
After the public hearing, the County Council may grant or deny the request to open such road. If granted, the County Council shall pass a resolution accepting the road into the County roads system. If granted, the property owner shall execute for recordation a right-of-way instrument in favor of the County for the new road opened.
E. 
The County Council, on its own initiative, may open a new County public road in accordance with this section.

All applications for the closing of public County roads shall be in writing to the County.
B. 
All such applications shall be accompanied with the following:
(1) 
A check from the applicant to pay for the publication expenses; and
(2) 
Plats, surveys and legal descriptions for that portion of the County public road requested to be closed.
C. 
Should the County Council desire to proceed with such request, any member of the County Council may introduce a bill, in legislative session, and thereafter the matter shall proceed in accordance with Article 3 of the Charter of Dorchester County, Maryland.
D. 
The County Council, on its own initiative, may close a County public road in accordance with this section.
