This article is adopted for the protection and promotion of the public health, safety and general welfare of the community by regulating the storage of garbage and other waste materials as well as the use and maintenance and operation of bulk garbage containers referred to as "dumpsters."
As used in this article, the following terms shall have the meanings indicated:
ASHES
Residue from fires used for cooking and heating and on-site incineration.
DUMPSTER
A bulk storage container for garbage and other waste materials that can be hauled directly to the point of disposal or emptied into a larger compactor-type truck for disposal.
GARBAGE
Wastes from the preparation, cooking and serving of food; market wastes and wastes from handling, storage and sale of produce.
RUBBISH
A. 
Combustible: paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture and bedding dunnage.
B. 
Noncombustible: metals, tin cans, metal furniture, dirt, glass, crockery and minerals.
WASTE MATERIALS
Includes all categories of materials to be disposed of, excluding garbage.
The property owner, lessee or the user of the container shall make provision to have the collection from the dumpster on such a schedule so that garbage and other waste materials do not accumulate so as to overflow the confines of the container or restrict the closing of the container cover.
A. 
All dumpsters shall be enclosed on all sides by a solid fence and gate enclosure, the height of which shall exceed the height of the dumpsters by a minimum of one foot.
B. 
No dumpster shall be located in or on a public right-of-way. Dumpsters shall be set back a minimum of 20 feet from any road right-of-way or property line.
C. 
Garbage and other waste materials must be completely contained within the dumpster. No accumulation of garbage or waste materials will be permitted outside the confines of the dumpster, nor will it be permitted to accumulate garbage or other waste materials so that the dumpster cover cannot be firmly closed.
D. 
Dumpster covers shall be kept closed at all times.
E. 
All dumpsters shall be kept in good repair, be structurally sound, leakproof and be easily opened and closed. Dumpsters shall be painted as required to prevent the show of rust and deterioration and be so constructed to stand firmly upright.
F. 
All dumpsters shall have the name of the company or individual owning such dumpster clearly printed, in letters at least three inches high, on either the front or the back of such dumpster.
G. 
Unauthorized use of a dumpster shall be considered a trespass subject to the penalties of § 84-15 of this chapter.
Relief from any of the provisions of this article alleged to be a hardship may be obtained by submitting, in writing, to the Board of Trustees of the Village, a statement detailing the hardship and the relief requested. The Board of Trustees shall review the submission and render a decision thereon within 30 days. If the hardship involves site location of a dumpster, a site plan of the property shall be submitted showing the proposed site location of the dumpster with the distance from property line or right-of-way and whatever pertinent information the petitioner may feel will be relevant to his presentation.
The provisions of this article shall apply to the owner of the dumpster as well as to the user or lessee of the container.
