A.
Whenever the Public Works Administrator, Enforcement
Officer or any other Village representative finds that any user has violated
or is violating this chapter, or any order, prohibition, limitation or requirement
permitted by this chapter, the Enforcement Officer may serve upon such person
a written notice stating the nature of the violation. Within two calendar
days of the date of the notice, an explanation of the violation and a plan
for the satisfactory correction and prevention thereof shall be submitted
to the Enforcement Officer by the user. The correction and prevention plan
shall include specific actions. Submission of this plan in no way relieves
the user of liability for any violations caused by the user before or after
receipt of the notice of violation.

When the Enforcement Officer finds that a user has violated
or continues to violate this chapter or a permit or order issued thereunder,
he may issue an order to the user responsible for the discharge directing
that, following a specified time period, sewer service shall be discontinued
unless the violation is corrected and that there is no reoccurrence of the
violation. Orders may also contain such other requirements as might be reasonably
necessary and appropriate to address the noncompliance.
Any person who fails to comply with the provisions of this chapter other
than those provisions pertaining to the payment of charges for services established
herein, shall be guilty of an offense against this chapter, and shall be subject
to fine not exceeding $250 and/or imprisonment for not more than 15 days,
or both such fine and imprisonment, for each offense. The continued violation
of any provision of any section of this chapter, other than those pertaining
to the payment of charges for services established herein, shall constitute
a separate offense for each and every day such violation of any provision
hereof shall continue.
As an alternative, upon violation of this chapter, the proper authorities
of the Village, in addition to other remedies, may institute any appropriate
action or proceedings to compel compliance with or to restrain the violation
of any provision of this chapter.
If at any time, or for any reason, it is found that this chapter may
conflict with the rules and regulations of the Madison County Sewer District,
or matters arise that are not covered in this chapter, the rules and regulations
of the Madison County Sewer District shall supersede this chapter.
