Any person desiring to maintain or continue to maintain any such fowl yard or pen shall first obtain from the Board of Trustees an annual permit therefor. Such permit shall be issued upon application, in writing, and upon payment of an annual fee as set by the Board of Trustees by resolution of a majority vote of its members present at a Board meeting.[1] Said permit shall expire on May 31 succeeding the day of its issuance. No such fowl yard or pen shall be constructed or maintained without such a permit.

Editor's Note: The fee schedule is on file in the Village offices.
Before any annual permit is issued as provided in § 76-13 hereof, the person desiring to maintain such chicken, duck or other fowl yard or pen shall file a statement accompanying the application which shall set forth the maximum number of chickens, ducks or other fowl to be maintained during the license period, and upon the granting of such license or permit such applicant shall be limited to the maintenance of the number of chickens, ducks or other fowl not exceeding the amount allowed in such permit. This provision shall apply to all persons heretofore or hereafter maintaining a chicken, duck or fowl yard.
No chicken, duck or other fowl yard or pen shall be built or maintained in the Village without the approval of the Board of Trustees, nor shall any chicken, duck or other fowl yard be maintained within 25 feet of any stream or within 25 feet of any street or dwelling, nor shall any such yard or pen or any portion thereof be located a distance of less than 10 feet inside of the side or rear property line of any parcel of property upon which the same shall be located. All such pens or yards shall be kept in a clean and sanitary condition and all filth accumulating in or about the same shall be promptly removed.
It shall be unlawful for any person to maintain any chicken, duck or other fowl yard or pen in which shall be kept more than a total of 10 such chickens, ducks or other fowl, except in such places within the business zones of the Village in which such chicken, duck or other fowl yard or pen has been operated and continuously maintained for a period of one year prior to July 8, 1948, and except pigeon coops and roosts.
