The following annual sewer rents are hereby established for premises connected with the public sewer:
A. 
Private residences (including one-, two- and three-family dwellings):
(1) 
One-family dwellings: $199.75 and $25.34 for each outlet in excess of 15.
(2) 
Two-family dwellings: $399.52 and $25.34 for each outlet in excess of 15.
(3) 
Mother/daughter dwellings: $399.52 and $25.34 for each outlet in excess of 15.
(4) 
Three-family dwellings: $598.99 and $25.34 for each outlet in excess of 15.
B. 
Multiple dwellings:
(1) 
Multiple dwellings: $1,774.75, and $199.76 for each apartment over four.
(2) 
In addition, apartments that are used for professional purposes will be billed as such.
C. 
Stores and commercial establishments:
(1) 
Each store and/or commercial establishment containing a water closet or two to four outlets and which is under 800 square feet: $509.28, plus $73.33 for each outlet in excess of four.
(2) 
Each store and/or commercial establishment containing a water closet or two to four outlets and which is 801 square feet to 2,000 square feet: $916.70, plus $73.33 for each outlet in excess of four.
(3) 
Each store and/or commercial establishment containing a water closet or two to four outlets and which is 2,001 square feet to 3,000 square feet: $1,222.28, plus $73.33 for each outlet in excess of four.
(4) 
Each store and/or commercial establishment containing a water closet or two to four outlets and which is 3,001 square feet or over: $1,833.41, plus $73.33 for each outlet in excess of four.
D. 
Office buildings, including business and professional offices:
(1) 
Each office building and each individual business and professional office within said building containing a water closet or two to four outlets and which is 800 square feet or less: $509.28, plus $73.33 for each outlet in excess of four.
(2) 
Each office building and each individual business and office within said building containing a water closet or two to four outlets and which is 801 square feet or more: $916.70, plus $73.33 for each outlet in excess of four.
E. 
Restaurants. Restaurants shall be charged an annual sewer rent in the amounts as herein above listed under Subsection C for stores and commercial establishments. In addition thereto, recognizing the need for control and limitations upon the flow of water resulting from restaurant uses and the resultant impact upon the water pollution control plant and facilities of the Incorporated Village of Cedarhurst, each restaurant shall pay an annual fee in such amount as may be fixed by resolution of the Board of Trustees, unless otherwise exempt from such additional fee as hereinafter provided.
(1) 
Any and all restaurants shall be limited in its/their water usage, and usage shall not exceed 50 gallons of water per seat per day. Such limitation shall refer to the number of seats as such establishment may be entitled to and/or authorized by the Building Department.
(2) 
Within five days of a written request from the Building Department, each operator of a restaurant shall submit to the Building Department a copy of its water bills for the purpose of confirming said usage.
(3) 
The exceeding of the above limitations on water usage and/or failure to supply water bills as above required shall be deemed a violation of this section and shall subject any such violator to a fine not exceeding $250 per day. Each day that a violation may continue shall be considered a separate violation hereof. In the event of such a violation, any such violator shall also be deemed a disorderly person and shall be subject to the penalties further set forth in Chapter 1, General Provisions, Article III, § 1-15, of this Code.
(4) 
Exemptions. Any restaurant may, upon application, be determined to be exempt from the payment of the additional fee payable pursuant to this Subsection E if such restaurant's actual use of water shall be no more than 300 gallons of water per day. Such usage shall be determined and/or confirmed by the Superintendent of the Building Department based upon an annual application for such exemption, to be submitted by the owner/operator of such restaurant, together with water bills for the year immediately preceding such application, confirming the actual use of water for such restaurant as averaging no more than 300 gallons per day. The applicant must make such application annually.
F. 
Other institutions. Institutions such as public or private schools and educational establishments, including libraries and museums, churches and other premises owned by said institutions, including one- or two-family residences of clergy or other personnel: $2,114.19, plus $190.26 for each outlet in excess of 15.
G. 
Mixed use requires payment for each use. Where the premises is used for more than one of the above uses, each individual use shall require the payment set forth in Subsections A through E for that use as if it were an individual use.
H. 
Other premises. Other premises, as fixed by the Building Official, shall be in conformity as nearly as may be with the rates specified in Subsections A through G.[1]
