This article shall be known and may be cited as the "Animals Law of
the Village of Central Square, New York."
No person shall keep any horse, cow, sheep, fowl, goat or swine within
the corporate limits of the Village except that Village residents owning animals
at the time of the passage of the ordinance from which this section was derived
shall be allowed to do so until such ownership ceases.
No person shall entice or induce dogs to fight in any of the streets
or public places of the Village.
A.
Except as provided in § 64-2 of this chapter, no person shall keep any livestock, fowl or other animals, reptiles, snakes, fish and dogs with 1/8 or more Wolf Blood lines in the Village except household pets.
B.
"Customary household pets" are hereby defined to mean
any animals, birds or fish customarily kept in the home or place of residence
which are not vicious, dangerous, or otherwise objectionable or offensive.
A violation of any provision of this article is hereby declared to be
a violation and shall be punishable by a fine not exceeding $250 or imprisonment
of not more than 15 days, or both.
The Village of Central Square, New York finds that the uncontrolled
behavior of dogs has caused physical harm to persons, damage to property and
created nuisances within the Village. The purpose of this article is to protect
the health, safety and well-being of persons and property by imposing restrictions
and regulations upon the keeping of dogs and the seizure thereof within the
Village.
This article is enacted pursuant to the provisions of § 124
of Article 7 of the Agriculture and Markets Law.
The title of this article shall be the "Dog Control Law of the Village
of Central Square."
As used in this article, the following terms shall have the meanings
indicated:
To provide food or shelter to any dog.
Any person who harbors or keeps any dog. In the event any dog found
in violation of this article shall be owned by a person under 18 years of
age, the owner shall be deemed to be the parent or guardian of such person
(or the head of the household in which the said person resides).
It shall be unlawful for any owner of any dog to permit or allow such
dog, in the Village of Central Square, to:
A.
Engage in habitual loud howling, barking, crying or whining
or to conduct itself in such a manner so as to unreasonably and habitually
annoy any person;
B.
Cause damage or destruction to property, or commit a
nuisance by defecating or urinating upon the premises of a person, other than
the owner's property of such dog;
C.
Chase or otherwise harass any person in such a manner
as reasonably to cause intimidation or to put such person in reasonable apprehension
of bodily harm or injury; or
D.
Habitually chase, run along side of or bark at motor
vehicles, bicycles or pedestrians.
This article shall be enforced by any Dog Control Officer, peace officer,
when acting pursuant to his/her special duties, or police officer in the employ
of or under contract to the Village of Central Square.
A.
Any dog found in violation of the provisions of § 64-10 of this article may be seized pursuant to the provisions of § 118 of the Agriculture and Markets Law.
B.
Every dog seized shall be properly cared for, sheltered,
fed and watered for the redemption periods set forth in § 118 of
the Agriculture and Markets Law.
C.
Seized dogs may be redeemed by producing proof of licensing
and identification pursuant to the provision of Article 7 of the Agriculture
and Market Law and by paying the impoundment fees set forth in § 118
of said Article.
D.
If the owner of any unredeemed dog is known, such owner
shall be required to pay impoundment fees set forth in Subdivision E of this
section whether or not such owner chooses to redeem his or her dog. Impoundment
fees are established at $5 per day.
E.
Any dog unredeemed at the expiration of the appropriate
redemption period shall be made available for adoption or euthanized pursuant
to the provisions of § 118 of the Agriculture and Markets Law. Unredeemed
dogs shall be made available for adoption as provided in Subdivision 7 of
§ 118 of the Agriculture and Markets Law. Licensing will be required
upon adoption. The redemption period for seized dogs shall be five days, or
seven days when notified by mail as provided in Subdivision 7 of § 118
of the Agriculture and Markets Law.
Any person who observes a dog in violation of this article may file
a complaint under oath with a Justice of the Village of Central Square, specifying
the nature of the violation, the date thereof, a description of the dog and
the name of the residence, if known, of the owner of such dog. Such complaint
may serve as the basis for enforcing the provisions of this article.
Any Dog Control Officer, peace officer, when acting pursuant to his/her
special duties, or police officer in the employ of or under contract to the
Village of Central Square, having reason to believe that a person has violated
this article, may issue and serve on such person an appearance ticket for
such violation pursuant to § 114, Subdivision 4, of the Agriculture
and Markets Law.
Any person convicted of a violation of this article shall be liable
to a fine not to exceed $25 for a first violation, not exceeding $50 for a
second violation and not exceeding $100 for each subsequent violation.
