With regard to attendance by members of the Zoning Board of
Appeals of the Town of Geneseo at its meetings, the failure to attend
any two regular or special meetings of such Board in succession or
a total of three such meetings thereof during a calendar year without
satisfactory excuse may be determined to be cause by the Town Board
of the Town of Geneseo for removal of that member from such Board
pursuant to § 267, Subdivision 1, of the Town Law after
a public hearing in accordance with the provisions of said section.
The term "satisfactory excuse" shall include illness, accident, other
excuses of medical nature, death in the immediate family and such
other excuses as the Town Board may regard as acceptable after review
thereof.

Compensation of the members of the Zoning Board of Appeals shall
be as set forth from time to time by resolution of the Town Board.

Board members are required to attend a Planning Institute sponsored
by the New York State Planning Federation within one year of appointment
to the Board. Reasonable expenses of the member in attending such
Institute shall be reimbursed to the member by the Town.

The terms of the members of the Board of Appeals of the Town
of Geneseo now provided for in § 267 of the Town Law of
the State of New York shall henceforth be two years each, notwithstanding
the provisions of such statute.

New York State Town Law § 267(11) authorizes the Town
Council to create the position of alternate Zoning Board of Appeals
member in cases of conflict of interest, and Municipal Home Rule Law
§ 10 authorizes the Town Council to create the position
of alternate Zoning Board of Appeals member in all other cases. It
is intended hereby to establish the position of alternate Zoning Board
of Appeals member.
The position of alternate Zoning Board of Appeals member is
hereby created for purposes of substituting for Zoning Board of Appeals
members in the event that a Zoning Board of Appeals member is unable
to serve because of a conflict of interest or for any other reason.
Such alternate Zoning Board of Appeals members shall be appointed
by resolution of the Town Council, for terms established by the Town
Council.
The Zoning Board of Appeals Chairperson may designate an alternate member to substitute for a Zoning Board of Appeals member when such member is unable to participate due to a conflict of interest or is otherwise unavailable to participate on an application or matter before the Board, provided that such alternate member has been appointed to the position of alternate member by the Town Council pursuant to §
33-7 of this article. When so designated, such alternate member shall have all the powers and responsibilities of such member of the Board. Such designation shall be entered into the minutes of the initial Zoning Board of Appeals meeting at which the designation occurred.
All other provisions of law relating to Zoning Board of Appeals
member training, and continuing education, attendance, conflict of
interest, compensation, eligibility, vacancy in office, removal and
service on other boards shall also apply to alternate members.
This article shall take effect immediately upon its filing with
the New York State Department of State.
