This chapter shall be known as the "Town of LeRay Local Law for refusing
Administration and Enforcement Responsibility of the New York State Uniform
Fire Prevention and Building Code" (also known as the "Uniform Code").
The purpose of this chapter is to meet the requirements for administration
and enforcement of the New York State Uniform Fire Prevention and Building
Code. These requirements are outlined in § 381 of Article 18 of
the State Executive Law.
Under the authority of § 381, Subdivision 2, of Article 18
of the State Executive Law the Town of LeRay hereby enacts this chapter prior
to the first day of July 1996 providing that it will not enforce the Uniform
Fire Prevention and Building Code on and after the first day of January 1997.
The Town of LeRay herein realizes that this chapter shall be in effect until
it shall be repealed, at which time the municipality shall administer and
enforce the Uniform Fire Prevention and Building Code immediately thereafter.
The Town of LeRay also acknowledges the fact that by refusing to administer
and enforce the Uniform Code they may be allowing either the County or state
to enforce the Uniform Code on their behalf, and in their community.
