This article shall be known and may be cited as the "Local Law Providing for Water and Sewer Connection Fees and Fire Service Charges."
This article is adopted pursuant to the authority and provisions of the Municipal Home Rule Law and the Town Law.
The purpose of this article is to provide a schedule of fees charged to any person or entity requesting municipal water and/or sewer service to any structure and to provide a schedule of fees where fire sprinkler systems have been installed in structures (other than dwelling units) anywhere within the Town of LeRay where municipal sewer and/or water service is provided by the Town or its special improvement districts.

A. 
A water connection fee shall be charged to any person or entity requesting water service as follows:
(1) 
For single-family dwellings: $450 plus cost of meter.
(2) 
For all other structures or uses, including but not limited to commercial, industrial, institutional, and multifamily:
(a) 
Five hundred dollars plus cost of meter (and out-of-pocket cost, if any) for up to a one-inch service; or
(b) 
One thousand dollars plus cost of meter (and out-of-pocket cost, if any) for larger than a one-inch service.
(3) 
Reconnect fee: $35 during normal operator working hours; $75 outside normal operator working hours.
(4) 
Late charge: 1% per month after 30 days.
B. 
The above fees shall be due and payable to the Town Clerk on or before a certificate of occupancy is issued to the applicant or 30 days prior to the requested commencement of water service, whichever shall occur earlier.

A sewer connection fee shall be charged to any person or entity requesting sewer service as follows:
(1) 
For single-family dwellings: $150 plus cost of meter.
(2) 
For all other structures or uses, including but not limited to commercial, industrial, institutional, and multifamily:
(a) 
Five hundred dollars (and out-of-pocket cost, if any) for up to a six-inch lateral service; or
(b) 
One thousand dollars (and out-of-pocket cost, if any) for larger than a six-inch lateral service.
(3) 
Late charge: 1% per month after 30 days.
B. 
The above fees shall be due and payable to the Town Clerk on or before a certificate of occupancy is issued to the applicant or 30 days prior to the requested commencement of service, whichever shall occur earlier.

A quarterly fire service charge in the following amounts shall be due and payable to the Town Clerk by any person or entity constructing, establishing, installing or using a sprinkler system in a nondwelling structure, as follows:

The definitions of "dwelling," "public and semipublic facilities/institutions" and "structure" shall be the same as described in Chapter 158, Zoning, as amended.
The provisions of this article shall apply to all persons or entities where sewer and/or water service from the Town or from any special improvement district of the Town is provided.
