There shall be for the Borough established a Board of Health, in accordance with the provisions of N.J.S.A. 26:3-1 et seq.

The Board of Health shall consist of seven members. Members of the Board of Health shall be appointed by the Mayor, subject to the confirmation by the Council and shall hold office for the term of three years. If any vacancy shall occur in the Board, it shall be filled in the manner hereinbefore provided, but for the unexpired term only.

In addition to the full-term members, there shall be a Board of Education Liaison, appointed by the Mayor of the Borough of Highland Park. The Liaison shall be appointed for a one-year term. The Liaison may participate in discussion of the proceedings, but may not vote.
The Board of Health shall not contract any debt of any kind beyond the amount of the appropriation made for its use by the Borough Council.

A. 
The Board of Health may provide for the appointment of two alternate members. The Mayor shall appoint the alternate members. The members shall be designated at the time of appointment as "Alternate Number 1" and "Alternate Number 2."
B. 
The terms of the alternate members of the Board of Health shall be two years, except that the terms of the alternate members first appointed shall be two years for Alternate Number 1 and one year for Alternate Number 2, so that the term of not more than one alternate member shall expire in any one year. A vacancy occurring otherwise than by expiration of term shall be filled by the appointing authority for the unexpired term only.
C. 
An alternate member shall not be permitted to act on any matter in which he has either directly or indirectly any personal or financial interest. An alternate member may, after public hearing if he requests one, be removed by the governing body for cause. Alternate members may participate in discussions of the Board, but shall not vote except in the absence or disqualification of a regular member. In the event that a choice must be made as to which alternate member is to vote, Alternate Number 1 shall vote first.

A. 
The Borough through the Board of Health made a contract with the Middlesex County Public Health Department to reinspect retail food establishments and conduct initial plan reviews for retail food establishments within said Borough and authorize the County Public Health Department to charge the following fees therefor:
(1) 
Retail food establishment reinspection: $50.
(2) 
Retail food establishment initial plan review: $100.
(3) 
Failure to pay fee within 10 working days:
(a) 
First penalty: $100.
(b) 
Second penalty: $200.
(c) 
Third and subsequent penalties: $400.
B. 
All fees are payable to the Middlesex County Public Health Department within 10 business days of the reinspection or plan review. The above-referenced fees and any subsequent court costs shall be in addition to the fines provided above for anyone found guilty of a violation of this section of the Code.
