A. 
Illegal drugs, prostitution, gambling, defacement of property, unlawful consumption of alcohol, the emerging issue of gang violence and other serious disturbances have adversely impacted our community's quality of life. It is the Common Council's duty and intention to protect and promote the City's safety, public health, commerce and welfare.
B. 
It is the purpose to this chapter to create a standardized procedure for securing legal and equitable remedies relating to such public nuisances. It is this Council's intention to create and administer this system in a fair and just manner, recognizing the rights of property owners and without prejudice to the use of procedures available under existing and subsequently enacted laws.
As used in this chapter, the following terms shall have the meanings indicated:
CORPORATION COUNSEL — The Corporation Counsel of the City of Kingston or his/her designee.
CRIMINAL CONVICTION
The entry of a plea of guilty to, or a verdict of guilty upon, an accusatory instrument or to one or more counts of such instrument as defined in the New York State Criminal Procedure Law § 1.20, Subdivision 13.
INCIDENT
An event, circumstance or activity.
MAYOR
The Mayor of the City of Kingston or his/her designee.
MORTGAGEE
The person in whose name the real estate affected by the order is recorded in the office of the Ulster County Clerk.
OWNER
The person in whose name the real estate affected by the order is recorded in the office of the Ulster County Clerk.
PREMISES
A building, structure, erection, place, real property, or any part thereof.
