The Borough Council finds that the lack of enforceable
regulations with regard to parking in fire lanes in parking yards
and parking places which are open to the public in the Borough poses
a potential and substantial threat to the health, safety and welfare
of the public. It is therefore the purpose of the Borough Council,
by this subchapter, to establish fire lanes within such areas of the
municipality to which the public is invited pursuant to N.J.S.A. 40:48-2.46
and thereby to promote the public health, safety and welfare.
Certain areas shall be designated as fire lanes
to ensure that fire equipment and other emergency vehicles have unobstructed
means of ingress, egress and passage along the fire lanes leading
to certain public and private buildings and facilities and to fire
hydrants, and otherwise in order to aid persons and property in case
of fire or other emergency.
A.
Authority is vested in the Chief of Police of the
Borough, in conjunction with the recommendations of the Chief of the
Fire Department and the Construction Official, to establish and designate
fire and emergency access lanes in and around parking yards and parking
places which are open to the public or to which the public is invited
in the Borough.
B.
The fire and emergency access lanes may include, but
are not limited to, no-parking or no-standing areas, traffic directional
lanes and areas designated solely for pedestrian traffic.
C.
Fire and emergency access lanes shall be in those
locations and of sufficient design as may be reasonably required for
the welfare and safety of the public.
D.
Lanes shall be installed by the property owner with
acceptable signs and paint on the pavement which shall be installed
and maintained under the guidance and direction of the Chief of the
Fire Department and the Chief of Police.
E.
The number, location, width, length and markings of
fire lanes shall be determined by the Police Chief and the Fire Chief
of the Borough consistent with the provisions of the National Fire
Prevention Code and other pertinent guidelines.
F.
Signs and lighting for lanes and the means of ingress
to and egress from lanes shall be determined according to standards
established by the municipality pursuant to N.J.S.A. 40:48-2.46 and
shall, in any event, conform to all those requirements set forth in
Title 39 of the Revised Statutes of New Jersey.
Copies of this subchapter or any amendment thereof
requiring posting of signs or painting of fire lanes shall be mailed
by certified mail or personally delivered to the owners of any affected
properties by the Fire Department. Property owners must install signs
and paint stripes on the pavement within 30 days of such service of
notice.
A.
Members of the Police Department shall have concurrent
jurisdiction with the Chief of the Fire Department and the Building
Inspector in enforcing this subchapter.
B.
A summons for a violation of this subchapter may be
served upon a defendant by affixing it to the vehicle involved in
the violation.
C.
If a violation represents an immediate hazard to the
safeguard of the public safety and welfare, the enforcing officer
may, in his discretion, have the vehicle or obstruction removed. The
reasonable cost thereof shall be paid by the person, persons or corporation
responsible for the violation.
A.
Any violation of the provisions of this subchapter
shall be punishable by a fine of not more than $500 or by imprisonment
of not more than 90 days, or both.
B.
Notwithstanding the penalties provided in this subchapter
for violations of this subchapter, the Borough is entitled to pursue
any other remedy available at law or equity to enforce the provisions
of this subchapter.
