No outdoor carnival or other traveling show shall be carried on or conducted in the Borough unless a license therefor shall be first had and obtained as hereinafter provided.
All licenses for outdoor carnivals or other traveling shows shall be issued by the Borough Clerk in the name of the Borough but only when the Borough Clerk shall have been first authorized to issue such license by a resolution adopted by the Borough Council.
Every application for a license for an outdoor carnival or other traveling show shall be presented to the Borough Council at a regular meeting, shall then be referred to the Police Committee for investigation and report and shall not be finally passed until a subsequent regular meeting. Such application shall be upon a form to be supplied the applicant by the Borough Clerk and shall contain the name or names and post office address or addresses of the applicant by the Borough Clerk, a description of the location whereon the outdoor carnival or other traveling show is to be carried on or conducted; a detailed description of the various amusement devices intended to be conducted or operated during the period for which the license is sought and any license issued upon such application shall be only for the amusement devices so described in the application; the period of time for which such license is sought; shall be signed by the applicant by the Borough Clerk and shall be verified under oath.
Upon a resolution being adopted by the Borough Council as aforesaid, a license shall be issued as aforesaid upon the applicant first paying to the Borough Clerk for the use of this Borough a license fee of $200 for each day or part of day during which the outdoor carnival or other traveling show is to be conducted and upon the applicant entering into bond with, as surety thereon, a bonding company authorized to do business within this state under the laws of this state, in the sum of $10,000 conditioned for the payment of the sum to the Borough if the licensee, his agents, servants, or sublessee shall operate the outdoor carnival or other traveling shows in an unsafe, disorderly or unlawful manner or in violation of any ordinance of the Borough now or hereinafter adopted, or if the licensee, his agents, servants or sublessees, shall violate any law in the operation thereof of if the licensee, his agents, servants or sublessees, shall conduct or operate any amusement device not specified in the application aforesaid.

Applicant shall furnish proof of general liability insurance in the amount of $1,000,000 and shall provide bond or other surety rates to the Clerk for the cleanup and restoration of the property.
Each person conducting or operating any outdoor carnival or other traveling show without first obtaining a license as herein provided and each person aiding or assisting in the conducting or operating any outdoor carnival or other traveling show for which a license has not been obtained as herein provided, shall, upon conviction, be subject to a fine as set forth in Chapter 1, General Provisions, Article III, General Penalty.
