No driveway or sidewalk entrance shall involve the bridging of the gutter line at the point of location of the driveway or sidewalk entrance, it being the intent of this article to prohibit in future the construction of driveways or sidewalk entrances requiring the building, maintenance and keeping open of culverts to provide for the free flow of water in gutters.
Every owner of premises on which there now exists a driveway or sidewalk entrance therefrom to the public roadway, constructed with a culvert, shall keep the culvert free of any dirt, stones, refuse or other matter which shall in any way tend to clog the culvert or to impede the free flow of water through it.
In the event that any such culvert becomes clogged as aforesaid, the Borough Council may cause the same to be cleaned, and the expense thereof shall be payable by the owner of the lands to which the driveway or entrance leads.
Where, in the opinion of the road supervisor, any existing culvert extends into the highway so as to be dangerous to either pedestrians or vehicles, or if the existing culvert is of such construction as to inadequately allow the free passage of surface water, it shall be the duty of the road supervisor to notify the property owner to remove the same, and upon the neglect or refusal of the property owner to remedy the matter, the road supervisor shall proceed to have the culvert removed and all expenses incurred charged to the property owner.
