The Municipal Court of the Borough is created and established pursuant to the statutes in such case made and provided, with all the functions, powers, duties, privileges and jurisdiction now or hereafter conferred by law. The court shall have a seal which shall bear the impression of the name of the court.

A Judge of the Municipal Court duly appointed by the Mayor with the advice and consent of the Council shall preside over the Court. The Judge of the Municipal Court shall have the qualifications required by law and shall be appointed for a term of three years and until his successor is appointed and qualified. His annual compensation shall be fixed and determined in the Borough salary ordinance and shall be in lieu of any and all other fees.

The Mayor shall also, with the consent and advice of the Council, appoint for the Court a Clerk or Acting Clerk, to perform the clerical work incident to the operation of the Court under the direction of the Judge of the Municipal Court. The compensation of the Clerk or Acting Clerk shall be fixed and determined in the Borough salary ordinance or resolution and shall be in lieu of any and all other fees or compensation for such services.

The appropriate municipal officials are authorized and directed to enter into an agreement with the Township of North Caldwell to consolidate the use of North Caldwell's Municipal Court accommodations, supplies and personnel with the Essex Fells Municipal Court pursuant to the following basic terms and conditions:
A. 
The proceedings of the Essex Fells Municipal Court shall be held in the facility of the North Caldwell Municipal Court, and both courts shall be served by the Judge, Prosecutor and Court Clerk serving the North Caldwell Municipal Court.
B. 
The total expenses of conducting and administering the Municipal Courts of both municipalities shall be apportioned 50% to the Township of North Caldwell and 50% to the Borough of Essex Fells.
C. 
This arrangement shall be for a term of one year and may be renewed and extended annually upon mutual agreement of each municipality.
