The owner or owners of land which has been excavated shall, within five days after such owner or owners shall have been notified in writing by the Select Board that in the opinion of the Select Board such excavation constitutes a hazard to public safety, erect barriers or take other suitable measures adequate to eliminate such hazard. Whoever violates this section shall pay for each offense a penalty of not less than $100 nor more than $200.
The owner or owners of land whereon is located an abandoned well or a well in use shall either provide a covering for such well capable of sustaining weight of 300 pounds or shall fill such well to the level of the ground. Whoever violates this section shall pay for each offense a penalty of not less than $100 nor more than $500.
