The Tree Warden will be appointed by the Town Supervisor from the membership of the Tree and Conservation Committee no later than one month after the Supervisor assumes his duties. Appointment is for a two-year term, subject to Town Board approval.
The Tree Warden will exercise jurisdiction over all shade trees within the town which fall into the following categories:
A. 
All roadside trees growing on town rights-of-way.
B. 
All trees on publicly owned land with the exception of incorporated villages.
C. 
Any trees situated on private land immediately adjacent to public ownership only in cases where the landowner requests technical assistance.

Trees which fall into § 34-2A or B above may not be cut, topped or pruned without prior written permission from the Tree Warden. Roadside trees considered unsafe by the Superintendent of Public Works must be inspected by the Tree Warden, who will grant or deny permission to cut same after a personal inspection.
The Tree Warden will submit a quarterly report to the Town Board meeting in January, April, July and October containing the following data:
A. 
Number of requests processed.
B. 
Number of trees authorized to be cut, giving sizes and species involved.
C. 
Number of trees saved from arbitrary cutting, giving sizes and species with locations.
D. 
Description of utility company cutting and/or pruning with an evaluation on quality of work accomplished.
E. 
A general statement on any arboreal problems worthy of mention to the Board.
Travel cost at the rate of $0.10 per mile traveled in performing warden duties will be paid upon receipt of vouchers at the end of each three-month period. The Tree Warden will receive no additional compensation.[1]
