The Town of Cornwall is concerned about the dumping, spreading and/or application of sludge on lands within the Town of Cornwall. Areas of the town are not served by public or community water supply systems, and the Town Board wishes to take steps to ensure the protection of the wells which supply domestic drinking water to homes and other improvements within the Town of Cornwall.
As used in this article, the following terms shall have the meanings indicated:
SLUDGE
Any solid, semisolid and/or liquid wastes generated from a municipal, commercial or industrial wastewater plant, water supply treatment plant or air pollution control facility, and includes the contents of a septic tank, cesspool or other industrial sewer treatment facility which receives domestic sewage wastes, as well as the accumulated semisolids deposited from wastewaters from municipal or private sewage plants.
TOWN BOARD
The Town Board of the Town of Cornwall, Orange County, New York.
The dumping or spreading of sludge on or under any lands within the Town of Cornwall, including the application of sludge on any lands in the Town of Cornwall, is hereby prohibited.

A. 
Any person who violates any of the provisions of this article or any section or subsection thereof shall be guilty of an offense punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both, for each violation. For each and every day that any such offense shall continue after notification that such violation exists, such activity shall constitute a separate violation.
B. 
In addition to the penalties set forth above, the town shall have the right to institute appropriate legal action or proceedings to prevent, to restrain, correct or abate a violation of this article.
