The Town Board of the Town of Cornwall hereby determines that it is in the best interests of the public health, safety and welfare of the citizens of the unincorporated area of the Town of Cornwall that private sanitary sewage disposal systems be designed by New York State-licensed design professionals and that a certification of the design and installation be presented to the Town of Cornwall. In addition, the Board believes that it is in the best interests of the citizens of the unincorporated area of the Town of Cornwall that where a building lot contains a subsurface sewage disposal system and a well, the location of both the well and the disposal system should be determined by the design professional and the location of each certified to have been installed in accordance with the design. The Board believes that this policy will ensure the continued good health, safety and welfare of those persons who reside on lots within the unincorporated area of the Town of Cornwall served by private sanitary sewage disposal systems and, in particular, those persons whose lots are served by wells and private sanitary sewage disposal systems.
As used in this article, the following terms shall have the meanings indicated:
NEW YORK STATE DESIGN PROFESSIONAL
A New York State-licensed professional engineer or a New York State-licensed land surveyor certified by the New York State Department of Education to design private sanitary sewage disposal systems.

Town of Cornwall.
TOWN BOARD
Town Board of the Town of Cornwall.
All new private sanitary sewage disposal systems within the unincorporated area of the town shall be designed by a New York State design professional in accordance with New York State Department of Health standards. A copy of the design of the new sanitary sewage disposal system, together with the proposed well location on the lot, where applicable, shall be filed with the town prior to the issuance of a building permit for an improvement to be constructed on the lot.
The sanitary sewage disposal system shall be inspected during construction and certified to the town by the design professional upon completion. The certification shall state that the sanitary sewage disposal system has been constructed in conformance with the design previously filed with the town and, where applicable, that the well is located in accordance with the previously filed design, which said certification shall be filed with the town prior to the issuance of a certificate of occupancy for the improvement constructed on the lot.
