[HISTORY: Adopted by the Board of Trustees of the Village of Dobbs Ferry 2-1-1966 as Ch. 3 of the 1966 Dobbs Ferry Village Code. Amendments noted where applicable.]

As used in this chapter, the following terms shall have the meanings indicated:
TAXICAB
Every motor vehicle having a seating capacity for passengers of not more than 13 persons, in addition to the driver, and used primarily in the business of transporting passengers for compensation within the Village of Dobbs Ferry or picking up and discharging passengers within the Village for trips within or without the Village of Dobbs Ferry.

TAXICAB DRIVER
Any person who operates a taxicab.
A. 
No person shall operate or permit to be operated a taxicab within the Village of Dobbs Ferry which is not licensed under the provisions of this chapter.
B. 
The Board of Trustees shall decide the number of taxicab licenses to be issued. If in any year the number of applications for taxicab licenses exceeds the number of licenses authorized, the Chief of Police shall determine which applicants shall be licensed. Such determination shall be based on the previous records, if any, of the applicants with respect to the condition of their taxicabs, the observance of the provisions of laws and ordinances affecting their operation and the character of service rendered. Such determination shall be subject to review by the Board of Trustees upon application. The Board of Trustees shall also set down rules for the operation of licensed taxicabs, including but not limited to the hours during which licensed taxicabs will be required to meet trains at the Dobbs Ferry Railroad Station.

C. 
Taxicab licenses shall be issued as of the first day of January of each year and shall be valid until the following December 31, unless sooner revoked as hereinafter provided. The fee for such license shall be as set from time to time by the Board of Trustees.[1] Where a motor vehicle licensed under this chapter is sold or otherwise disposed of by the holder of such license, the license shall be surrendered to the Village Clerk for cancellation; if within 30 days thereafter the holder of the license applies for the issuance of a license for another vehicle, such license shall be issued without fee, but otherwise on the same conditions as an original license.

D. 
Applications for licenses shall be made upon forms supplied by the Village Clerk and shall be accompanied by the required fee and a certificate of the Chief of Police that the vehicle sought to be licensed has been examined by a competent mechanic designated by him and found to be in good mechanical condition and clean and sanitary. Licenses shall be signed by the Mayor and countersigned by the Village Clerk and shall be affixed at all times to the windshield of the vehicle for which issued.
A. 
No person shall operate a taxicab within the Village of Dobbs Ferry except a taxicab driver licensed under the provisions of this chapter.
B. 
Taxicab drivers' licenses shall be issued as of the first day of January of each year and shall be valid until the following December 31, unless sooner revoked as hereinafter provided. The fee for such license shall be as set from time to time by the Board of Trustees.[1] Applications for licenses shall be made upon forms supplied by the Village Clerk and shall be accompanied by the required fee and two two-by-two-inch full-face photographs of the applicant taken within 30 days preceding the filing of the application, one of which shall be attached thereto. An application for such license must be the holder of a New York State chauffeur's license and of good moral character.

C. 
Licenses shall be numbered in the order in which they are issued, shall have depicted thereon a copy of the Map of Taxicab Fare Zones in the Village of Dobbs Ferry, New York, and Schedules of Maximum Fares Applicable Thereto; shall have attached thereto one of the photographs submitted with the application; shall have typed thereon the name and place of residence of the licensee and the dates of issuance and expiration of the license, and shall be signed by the Mayor and Village Clerk. Licenses shall be nontransferable.
D. 
All taxicab drivers shall be required to submit to the Village, prior to any taxicab driver's license being issued or renewed by the Village, a Westchester County Taxi and Limousine Commission driver's permit.

A. 
Taxicab drivers' licenses shall be conspicuously affixed in the rear compartment of each taxicab so as to be clearly visible and legible at all times to passengers therein when the taxicab is engaged in the business of carrying passengers for hire on an individual basis.
B. 
Taxicabs shall be kept in good operating condition.
C. 
Taxicabs shall at all times be maintained in a clean and sanitary condition.
D. 
Taxicab drivers shall not refuse calls from orderly persons unless previously engaged.
E. 
Taxicab drivers in the course of their business shall conduct themselves at all times in an orderly manner and shall not use offensive, disorderly, threatening, abusive or insulting language. They shall not solicit passengers unduly or in a noisy manner and shall refrain from acting in such a way as to annoy, disturb, interfere with, obstruct or be offensive to prospective or actual passengers or other taxicab drivers or other persons.
F. 
The times of operation of the taxicabs, together with the fares set forth in § 276-6, must be conspicuously posted in the taxicab.

G. 
Taxicab drivers must honor a request from a passenger(s) that no other passenger(s) be picked up until the passenger(s) is discharged.

The westerly side of Station Plaza from a point 545 feet north of High Street to a point 55 feet northerly therefrom shall be designated a taxicab stand to be used exclusively by taxicabs licensed within the Village of Dobbs Ferry.

The fare for any transportation where the pickup and discharge of passengers is within the Village of Dobbs Ferry is $6 for one passenger. There is an additional charge of $1 for additional passengers going to or coming from the same address. For any pickup of passengers after 10:00 p.m., there will be an additional charge of $1.
A. 
The Chief of Police may suspend a taxicab license and/or a taxicab driver's license issued hereunder immediately upon the preferring of a charge of a violation of this chapter or of any law or ordinance pertaining to the operation of a motor vehicle. The person or persons affected by such suspension may apply to the Board of Trustees for a hearing thereon within a period of 10 days after such suspension. In the event such application is made, the Board of Trustees, upon the completion of the hearing, may remove the suspension, continue the same for a period determined by it or revoke the license or licenses, and its determination shall be final.
B. 
In addition, a violation of any provision of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article I.
