Village of Fayetteville, NY Chapter 33 Traffic Violations Bureau

§ 33-1 Establishment.

The Board of Trustees of the Village does hereby enact this chapter authorizing the Justice of the Village Court of the Village to establish a Traffic Violations Bureau to assist the Court in the disposition of offenses relating to traffic violations.

§ 33-2 Disposal of violations.

Violations of traffic laws, ordinances, rules and regulations, except in the case where such offenses constitute the traffic infraction known as "speeding" or a misdemeanor or a felony, shall be disposed of by permitting the person charged with an offense, within the limitations herein stated, to answer, within a specified time, either in person or by written power of attorney as set forth on the Notice of Parking Violation ticket adopted by the Board of Trustees of the Village,[1] by paying a prescribed fine as provided by such ticket, waiving a hearing in Court, pleading guilty to the charge and authorizing the person in charge of the Traffic Violations Bureau to make such a plea and pay such a fine in Court.

§ 33-3 Satisfaction of violation.

Acceptance of the prescribed fine and power of attorney by the Traffic Violations Bureau of the Village shall be deemed complete satisfaction for the violation, and the violator shall be given a receipt which so states.

§ 33-4 Failure to answer summons.

If a person charged with a traffic violation does not answer the summons set forth in this chapter within the designated time, the Traffic Violations Bureau shall cause a complaint to be entered against him forthwith and a warrant to be issued for his arrest and appearance before the Court.

§ 33-5 Who must appear in court.

Any person who shall have been, within the preceding 12 months, guilty of a number of parking violations in excess of such maximum number as prescribed on the Notice of Parking Violation or of three or more violations other than parking violations shall not be permitted to appear and answer a subsequent violation at the Traffic Violations Bureau but must appear in Court at a time specified by the Bureau.
