For the purposes of this article, the following terms shall have the meanings respectively ascribed:
PARK
Any municipal park or recreational facilities owned, operated or under control of the Village.
PERMIT
A written authorization issued by and under the authority of the Village Clerk, with the approval of the Mayor, permitting the performance of a specified event or contest in any of the parks or recreational facilities.
Rules and regulations for parks, park areas and park buildings may be made from time to time by the Village Board of Trustees. All persons must comply with the rules and regulations after the same have been promulgated and approved by the Village Board of Trustees and posted at the park premises.
Any request for a permit for the use of any facilities of any park or park area, fields or buildings or part of any building therein shall be made upon written application to the Village Clerk. Time of use shall be designated in the permit by the Village Board of Trustees.
The following uses and activities shall be and are hereby prohibited in a park or park area:
A. 
Injury to property. No person in a park or park area shall injure, deface, displace, remove, destroy or tamper with any gates, fences, seats, shelters or structures of any nature whatsoever, or any equipment or building or part thereof, or any sign, notice or inscription, or any growing thing, owned, operated or under control of the Village.
B. 
Rubbish, debris. No person shall carry through, leave or throw, drop or discharge any rubbish or debris of any nature in any park or park area.
C. 
Spitting. No person in any park or park area or any building or structure therein owned or operated by or under the control of the Village shall expectorate upon any portion thereof or in any structure, walk, stairway or floor.
D. 
Advertising. No person shall distribute or display any flag, banner, sign or any other matter for advertising purposes within any park or park area, nor attempt to attract attention for advertising purposes by the use of any musical instrument or any sound device within any such area.
E. 
Soliciting. No person shall solicit for any purpose whatsoever.
F. 
Disorderly conduct. No person shall annoy persons or people or do any act tending to create a nuisance and breach of the peace.
G. 
Abusiveness, obscenity. No person shall use threatening, abusive, profane or obscene language or perform any obscene or indecent act.
H. 
Entry, exit. No person shall enter or leave any park or park area or building except by the established entranceways or exits.
I. 
Acts causing injury. No person shall do any act of any nature whatsoever which will cause or contribute to the injury of any person, animal or property within any park or park area.
J. 
Disrobing. No person shall disrobe or assist, aid or abet any person to disrobe within the park or park area except in designated places.
K. 
Camping. No person shall tent, camp or erect or maintain a tent shelter in any park or park area except by permission.
L. 
Weapons, fireworks. No person shall bring in or have in his possession in any park or park area any firearms or concealed weapons or fireworks of any nature whatsoever.
M. 
Sales. The sales of any wares, merchandise, foods and beverages of any type or nature within all park grounds is prohibited except with the written permission of the Village Clerk.
N. 
Fires. No person shall kindle, build or maintain a fire in any park or park area.
No vehicles except municipal vehicles shall be parked inside a park unless in a specified parking area.

It shall be unlawful for any person or persons to be or remain in any park, park area or park building in the Village at night after the hour of 10:00 p.m. unless pursuant to the terms of a valid permit.

A. 
The Village of Fayetteville Parks Commission is hereby created and established.
B. 
The Parks Commission shall consist of five regular members, who shall each be appointed to five-year terms by the Mayor, subject to the approval of the Board of Trustees.
C. 
Of such members, the Mayor shall appoint one as Chairman and one as Deputy Chairman, subject to approval of the Board of Trustees.
D. 
Of such members, the Mayor shall appoint one as liaison to the Village of Fayetteville Tree Commission and one such member as liaison to the Village of Fayetteville Recreation Committee.
E. 
The Parks Commission shall have the power to adopt rules for its procedure in government, not inconsistent with law or this article, subject to the approval of the Village Board of Trustees.
F. 
Associate members. In addition to its regular members, the Parks Commission may include up to two associate members who shall be appointed to one-year terms by the Mayor, subject to the approval of the Board of Trustees. Each associate member may attend meetings and may participate in deliberations including executive session deliberations unless excluded from such executive sessions by vote of the Commission. Each associate member shall have such additional powers and voting rights as are conferred upon them by § 187-43.1.

G. 
The Commissioners first appointed shall serve the following terms: one for one year, one for two years, one for three years, one for four years, and one for five years. All terms shall expire on March 31 of each successive year. Any vacancy shall be filled for the unexpired term only. The members shall serve until their respective successors are appointed and qualify.
H. 
Members of the Commission shall receive no compensation for their services.
A. 
The duties of the Parks Commission shall be as follows:
(1) 
To formulate and make recommendations regarding use, design and development of Village parks;
(2) 
To develop and recommend long-range plans for park maintenance and improvement;
(3) 
To make recommendations upon any proposed sale or purchase of park lands;
(4) 
Studying, investigating, reporting and making recommendations upon any special matter or question coming within the scope of the Commission's work;
(5) 
Reviewing and updating the Village Parks Master Plan biennially or more frequently at the direction of the Village Board;
(6) 
Investigating and recommending application(s) for park-related public grants to the Village Board, as necessary and appropriate; and
(7) 
Such other powers and duties related to parks as the Village Board, from time, delegates to the Parks Commission by resolution of the Board.
B. 
The Parks Commission shall confer with the Village of Fayetteville Tree Commission with respect to any recommendations pertaining to the planting, removal, relocation and/or maintenance of trees located within the Village parks.
