As used in this chapter, the following terms shall have the meanings ascribed to them in this section, except where the context clearly indicates or requires a different meaning.
LESSOR
One who grants a lease or rents real estate to another for either business or dwelling purposes.
PERSON
Any natural person, partnership, association, firm or corporation. The singular shall include the plural, and the masculine shall include the feminine and the neuter.
PERSONAL PROPERTY
Any tangible property that is the subject of ownership and is possible to be moved and which is generally used in the operation of a business or for the maintenance of a household.
TRANSPORTATION
The moving of personal property or household goods by way of public streets or highways.
It shall be unlawful for any individual 18 years of age or older to move into, out of or from one place to another within the Borough of Jim Thorpe without first giving notice to the Borough Secretary of such moving and obtaining a permit for such move. In the case of individuals moving into the Borough of Jim Thorpe, said notice shall be given within one week after moving into the Borough. In the case of individuals moving out of the Borough of Jim Thorpe or from one place to another, notice shall be given at least 24 hours before said move is made. Included in each such notice shall be the name of the moving person, the address from which the person is moving and the address to which said person is moving.
It shall be unlawful for any person to move or transport or cause to be moved or transported into, out of or within the Borough of Jim Thorpe any personal property in bulk without first obtaining from the Borough Secretary a permit for such moving or transportation·.
The application for a moving permit shall include the name and address of the applicant, the applicant's spouse, if any, the name of the owner or reputed owners of the personal property to be moved or transported, the address and location from which the personal property is to be moved or transported, the address and location to which the personal property is to be moved or transported, a certification by the applicant that all taxes and fees associated with the move, with the exception of real estate taxes, have been paid, and such other information as the Borough Council deems appropriate.
The Borough shall, upon application, issue a permit for a charge of $5, which fee may be changed by the Borough from time to time by resolution. Said permit shall set forth the name of the permittee as well as the name or names of the owners of the personal property to be moved or transported, the address from which the personal property or household goods are to be moved and the address to which the personal property or household goods are to be delivered.
Any lessor leasing or renting any premises or part thereof within the Borough to another person for the purpose of either a business or as a dwelling for a period in excess of 30 days shall give the Borough Secretary notice within one week after the leasing of said property to a tenant and at least 24 hours' notice of the intention of the lessee or tenant to move or vacate the leased or rented premises.
Any person who is in the business of transporting or moving personal property in bulk from one location to another as hereinbefore described shall be obligated to verify that the moving permit has been issued prior to the moving or transporting of any personal property either within the Borough of Jim Thorpe or to a point outside of the Borough of Jim Thorpe.
Any person who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 per violation, and/or imprisonment to the extent allowed by law, for the punishment of a summary offense.
