The proliferation of the construction and installation within the City
of Geneva of satellite antennas, parabolic dishes and other similar equipment
and devices must be controlled so as to protect the health, safety and welfare
of the citizens of the City of Geneva, and to the maximum degree possible,
coordinate and control the same so as to preserve and protect the aesthetic
qualities of the City of Geneva and its environs. Accordingly, this chapter
is enacted to accomplish this stated purpose and intent.
A.
No person shall install, maintain or operate a satellite
dish or similar device without having first obtained a permit from the Director
of Building and Zoning.
B.
Application for a permit shall be made to the said Director
on forms provided by his office and shall include construction drawings showing
the proposed method of installation and a site plan depicting the structures
on the property and all adjacent properties and all power lines as well as
the location of all existing power lines. The said Director may require an
applicant to submit such other and further information as may be reasonably
necessary to assist said Director in establishing compliance with the intent
of this chapter.
C.
The Director of Building and Zoning may either issue
a permit to an applicant or disapprove an application. Whenever a permit is
granted, appropriate conditions and safeguards may be attached thereto so
as to guarantee that the use, location and physical appearance of a satellite
dish or similar device shall not have an unreasonable adverse effect on neighboring
properties and uses in the vicinity and shall not be incompatible with the
general intent of this chapter.
D.
Any satellite receiving antenna in existence in the City
of Geneva, as of the date of adoption of this chapter, shall be allowed to
remain in the state and condition as it exists as of the date of adoption
of this chapter. However, each such antenna shall be brought into compliance
with this chapter within one year after the date of adoption of this chapter.
The following restrictions and conditions apply to satellite dishes
or similar devices where allowed:
A.
No antenna may be located in a front or side yard nor
shall such antenna be substantially visible from an adjoining street or roadway
at street level?
B.
Installation on or above any building or structure.
C.
Lots must be of sufficient size to allow for side line
setback and setback from existing structures equal to the height of the satellite
dish measured from the base at ground level plus five feet.
D.
Maximum allowed is one per lot.
E.
If any modifications are made to the structure, the Building
Inspector shall have the authority to require proof that any addition, change
or modification is in conformity with the permit and the Uniform Building
Code.
F.
The erection of any satellite dish under any power lines
must conform with NYSEG rules and regulations regarding clearances.
Any decision or requirement of the Director of Building and Zoning may
be appealed within 30 days of written notice of said decision to any applicant
to the Zoning Board of Appeals, and the Zoning Board of Appeals shall have
the authority to uphold, reverse or modify any decision of the Director of
Building and Zoning.
