The obstruction of public streets and ways by
abandoned shopping carts creates a dangerous and hazardous condition
to the public.
As used in this chapter, the following terms
shall have the meaning indicated:
Paved roadways, sidewalks, driveways, and municipal parking
areas.
A cart on wheels commonly provided by retail stores for removing
merchandise therefrom.
Any shopping cart made available for use by
a retail store shall have securely attached thereto a plastic or metal
identification tag 3 1/2 inches by five inches in size. The number
of the cart, the name and address of the owner and the location of
the premises where it is actually available for use shall be legibly
printed on the identification card.
Any shopping cart abandoned on any public street
or ways shall be removed by the Police Department of the Borough and
stored at the public works garage. The Department shall forthwith
give 10 days' written notice to the owner of the shopping cart to
redeem the cart within five days from the date of the notice upon
payment to the Borough of a fee of $50 for each shopping cart redeemed.
This fee is to cover the cost of recovery and administration of this
chapter.

A.
In the event that any shopping cart is not redeemed
within the period of time fixed, or is unidentified, in accordance
with N.J.S.A. 40A:14-157, the Police Department shall conduct a public
sale of the shopping carts. A specific term of such public sale shall
be that no cart shall be sold for less than $30.
B.
In the event that any shopping cart shall be unsold
at public sale and is not subject to claim by the finder under N.J.S.A.
40A:14-157, the Police Department may destroy such shopping carts.

The Police Department shall make monthly reports
to the Mayor and Council and hand over to the Borough Treasurer the
proceeds of all redemptions and sales.
